RESOLUTION 2013 -56R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AWARDING A CONSTRUCTION CONTRACT TO <br />HARRIS ROAD COMPANY, INC. FOR THE EDDIE DURHAM PARK <br />PROJECT IN THE AMOUNT OF $155,435.80 CONTINGENT UPON THE <br />PROPONENT'S TIMELY SUBMISSION OF SUFFICIENT BONDS AND <br />INSURANCE IN ACCORDANCE WITH THE CITY'S REQUEST FOR <br />PROPOSAL DOCUMENTS FOR THE PROJECT; AUTHORIZING THE <br />CITY MANAGER OR HIS DESIGNEE TO EXECUTE THE <br />CONSTRUCTION CONTRACT DOCUMENTS ON BEHALF OF THE <br />CITY AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The City has selected Harris Road Company, Inc. as the contractor for the <br />construction of the Eddie Durham. Park Project (the "Project ") in accordance with the <br />competitive sealed proposal process as authorized in Subchapter D, of the Texas Government <br />Code. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS <br />PART 1. The award of a construction. contract to Harris Road Company, Inc. for the <br />Eddie Durham. Park Project in the amount of $155,435.80 is approved contingent upon the <br />proponent's timely submission of sufficient bonds and insurance in. accordance with the City's <br />request for proposal documents for the Project. <br />PART 2. The City Manager or his designee is authorized to execute the contract <br />documents on behalf of the City. <br />PART 3.
