<br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, AMENDING THE FUTURE LAND,
<br /> USE MAP OF THE MASTER PLAN OF THE CITY, FROM
<br /> PERMANENT OPEN SPACE AND/OR FLOODPLAIN TO
<br /> COMMERCIAL FOR 1.625 ACRES OUT OF THE J.M.
<br /> VERAMENDI LEAGUE NO. 2, HAYS COUNTY, TEXAS,
<br /> BEING A PORTION OF THAT 12.81 ACRE TRACT OF
<br /> LAND CONVEYED TO BIMMS INVESTMENTS, A TEXAS
<br /> GENERAL PARTNERSHIP, BY RUTH EVANS BY DEED
<br /> DATED OCTOBER 10, 1983 AND RECORDED IN VOLUME
<br /> 404, PAGE 693, HAYS COUNTY DEED RECORDS,
<br /> LOCATED AT 1200 STATE HIGHWAY 80 AND DECLARING
<br /> AN EFFECTIVE DATE.
<br /> WHEREAS, on August 25, 1992, the Joint Planning and Zoning
<br />Commissions of the city of San Marcos held a public hearing
<br />regarding a request to amend the Future Land Use Map of the Master
<br />Plan from Permanent Open Space and/or Floodplain to Commercial for
<br />1.625 acres out of the J.M. Veramendi League No. 2, Hays County,
<br />Texas, being a portion of that 12.81 acre tract of land conveyed to
<br />Bimms Investments, A Texas General Partnership, by Ruth Evans by
<br />Deed Dated October 10, 1983 and recorded in Volume 404, Page 693,
<br />Hays County Deed Records, located at 1200 State Highway 80; and,
<br /> WHEREAS, subsequent to the public hearing on that date, the
<br />Commissions did, on August 25,1992, consider the request and voted
<br />to approve it and have recommended that the request be approved by
<br />the city Council of the city; and,
<br /> WHEREAS, the City Council held a public hearing on the 9thday
<br />of November , 1992, regarding the request; and,
<br /> WHEREAS, all requirements of the Master Plan pertaining to
<br />amendments have been met; and,
<br /> WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following resolution is in the interest of the
<br />public, health, morals, welfare and safety; now, therefore,
<br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br /> PART 1. That the following described tract of real property
<br />located at 1200 State Highway 80, San Marcos, Hays County, Texas,
<br />which is in an area shown on the Future Land Use Map of the Master
<br />Plan of the city of San Marcos as Permanent Open Space and/or
<br />Floodplain shall be shown on that map as Commercial:
