<br /> 8 <br /> RESOLUTION 1992 -144 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS SUPPORTING FEDERAL <br /> LEGISLATION TO END UNFUNDED FEDERAL <br /> MANDATES; AND DECLARING AN EFFECTIVE <br /> DATE. <br /> WHEREAS, unfunded federal mandates on State and Local <br />governments have become increasingly extensive in recent years; <br />and <br /> WHEREAS, such mandates have, in many instances, added to <br />growing deficits in State and Local budgets and have resulted in <br />the need for State and Local governments to increase revenue or <br />curtail services; and <br /> WHEREAS, such excessive fiscal burdens on State and Local <br />governments have undermined, in many instances, the ability of <br />State and Local governments to achieve their responsibilities <br />under State and Local law; and <br /> WHEREAS, Representative Gary A. Condit (D-CA) will introduce <br />legislation to assure that the federal government pays the total <br />amount of direct costs incurred by State and Local governments in <br />complying with certain requirements which take effect on or after <br />the date of enactment of the Act under a Federal statute or <br />regulation; and <br /> WHEREAS, this legislation will be introduced at the beginning <br />of the 103rd Congress; and <br /> WHEREAS, this legislation would provide that any requirement <br />under a Federal statute or reqgulation that a State or Local <br />government conduct an activity (including a requirement that a <br />government meet national standards in providing a service) shall <br />apply to the government only if all funds necessary to pay the <br />direct costs incurred by the government in conducting the activity <br />are provided by the Federal Government; and <br /> WHEREAS, Representative John Conyers (D-MI), Chairman of the <br />House Committee on Government Operations which has jurisdiction <br />over this issue, has agreed to hold hearings on the issue of <br />unfunded federal mandates during the 103rd Congress; now, <br />therefore <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> PART 1. That the City of San Marcos supports Representative <br />Gary A. Condit and Chairman Conyers in their effort to put an end <br />to unfunded federal mandates. <br /> PART 2. That the City of San Marcos goes on record as <br />supporting the legislation drafted by Representative Condit. <br /> PART 3.
