<br />~ rJ >-1 13 <br />~ ~:æ¡; <br />'Ill - t:i== <br />,~~ <6 ~.i ORDINANCE 1992- 89 <br />.....~ en <br /> <br /> <br /> <br /> <br />_Jo <...-) 'S <br />W~ ~ 58 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, INCREASING THE <br />RESIDENTIAL SOLID WASTE COLLECTION RATE TO <br />INCLUDE A FEE FOR RECYCLING SERVICES; <br />PROVIDING FOR SEVERABILITY; REPEALING ALL <br />CONFLICTING ORDINANCES; PROVIDING FOR <br />PUBLICATION; AND DECLARING AN EMERGENCY. <br /> <br /> <br />WHEREAS, the provision of recycling services under a contract <br />with Browning-Ferris, Inc. makes necessary a corresponding <br />increase in the City's solid waste collection rate charged to <br />residents; now therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That, pursuant to Section 12-8 (a) of the San <br />Marcos Code of Ordinances, the monthly charge for the collection <br />of garbage and rubbish from each residential unit located in the <br />city using bags and containers shall be $8.13. <br /> <br />SECTION 2. That if any word, phrase, clause, sentence, or <br />paragraph of this ordinance is held to be unconstitutional or <br />invalid by a court of competent jurisdiction, the remaining <br />provisions of this ordinance shall remain in effect as if the <br />unconstitutiona~ or:invalid portion had not been adopted. <br /> <br />SECTION 3. That all ordinances or parts of ordinances in <br />conflict with this ordinance are hereby repealed. <br /> <br />SECTION 4. That this Ordinance shall apply to billing,cycles <br />initiated by the City for solid waste collection and. disposal <br />services on and after January 1, 1993. <br /> <br />SECTION 5. That the importance of this Ordinance creates an <br />emergency and an imperative public necessity so that the <br />provisions of the Charter requiring that ordinances shall be <br />presented at three separate meetings and that no ordinance shall <br />become effective until the expiration of ten (10) days following <br />the date of its final passage be suspended, and these provisions <br />are hereby suspended, and this Ordinance shall take effect and be <br />in full force and effect from and after its adoption and after its <br />publication in a newspaper of general circulation within the City <br />as provided by the City Charter of the City of San Marcos. <br /> <br />PASSED, APPROVED AND ADOPTED this 14th day of December, <br />1992. ~. - <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />.
