15 ~ ~ ORDINANCE 1991- 38 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 12-8 OF THE SAN MARCOS CODE OF ORDINANCES TO INCREASE THE RESIDENTIAL SOLID WASTE COLLECTION RATE TO PROVIDE FUNDING FOR RECYCLING SERVICESi PROVIDING FOR SEVERABILITYi REPEALING ALL CONFLICTING ORDINANCESi PROVIDING A PENALTYi PROVIDING FOR PUBLICATIONi AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That subsection (a) of section 12-8 of the San Marcos Code of Ordinances is hereby amended to read as follows: (a) The monthly charge for the collection of garbage and rubbish from each residential unit located in the city using bags and containers shall be $8.09. SECTION 2. That if any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the remaining provisions of this ordinance shall remain in effect as if the unconstitutional or invalid portion had not been adopted. SECTION 3. That all ordinances and resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed. SECTION 4. That this Ordinance shall apply to billing cycles initiated by the City for said waste collection and disposal services on and after November 1. 1991 , and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
