<br />
<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br />OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL
<br />ZONING MAP OF THE CITY BY ZONING LOT 29, OUT
<br />OF THE SOUTH END ADDITION TO THE CITY OF SAN
<br />MARCOS, TEXAS, AS RECORDED IN VOLUME 55, PAGE
<br />601 OF THE HAYS COUNTY DEED RECORDS, LOCATED
<br />AT 610 ALABAMA STREET FROM "M" SINGLE-.FAMILY,
<br />DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT TO
<br />"R-1" SINGLE-FAMILY DWELLING DISTRICT (LOW
<br />DENSITY) AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on June 4,1991, the Zoning Commission of the city of
<br />San Marcos held a public hearing regarding a request to change the
<br />zoning from "M" Single-Family, Duplex and Neighborhood Business
<br />District to "R-1" Single-Family Dwelling District (Low Density) for
<br />Lot 29 of the South End Addition as recorded in Volume 55, Page 601
<br />of the Hays County Deed Records.
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Zoning Commission did, on June 4, 1991 consider the request and
<br />voted to approve it and has recommended that the request be
<br />approved by the City Council of the City; and,
<br />
<br />WHEREAS, the City Council held a public hearing on the 26th
<br />day of Auqust , 1991, regarding the request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been, met; and,
<br />
<br />WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the
<br />public health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:

<br />SECTION 1. That the Official Zoning Map of the City, as
<br />described in Section 3 of the General Zoning Ordinance is hereby
<br />amended to rezone the following described real property located at
<br />610 Alabama Street, in San Marcos, Hays County, Texas, which is
<br />presently zoned "M" Single-family, Duplex and Neighborhood Business
<br />District to "R-1" Single-family Dwelling District (Low Density):
<br />
<br />LOT 29, SOUTH END ADDITION TO THE CITY OF SAN MARCOS AS
<br />RECORDED IN VOLUME 55, PAGE 601 OF THE HAYS COUNTY DEED
<br />RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10)
<br />days from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting
<br />following its passage, and providing that the Council did not vote
<br />to reconsider it. If reconsidered on September 9, 1991it shall be
<br />in effect ten days from and after its passage on that date if
<br />approved. It shall not go into effect if denied. If not
<br />reconsidered and approved it shall be published in a newspaper of
<br />general circulation in the area as required by the Charter of the
<br />City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 26th day of August, 1991,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for September 9, 1991 .
