<br />~ 68 <br />'..::s;- <br />- <br /> <br /><:::- <br />0 <br /> <br />~ ORDINANCE 1991- 51 <br />~ <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 16, MISCELLANEOUS <br />OFFENSES AND PROVISIONS BY ADDING A SECTION TO LEVY <br />A LICENSE TAX ON THE SALE AND CONSUMPTION OF <br />ALCOHOLIC BEVERAGES WITHIN THE CITY: PROVIDING FOR <br />SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES: <br />PROVIDING FOR PUBLICATION AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That Section 16-14 be added to Chapter 16, <br />Miscellaneous Offenses and Provisions to read as follows: <br /> <br />Sec. 16-14. Alcoholic beverages~license tax. <br /> <br />(a) There is hereby levied and shall be assessed and <br />collected by the Finance Department a license fee equal in <br />amount to one-half of the amount levied by the state for its <br />use, on all persons engaged in the sale or manufacture of <br />beer, wine or liquor within the city. The time for payment <br />of such license fee shall be the same as provided by the <br />state under the state alcoholic beverage code. <br /> <br />(b) The following are exempt from the fee authorized in <br />this section: <br /> <br />(I) agent's, airline beverage, passenger train <br />beverage, industrial, carrier1s, private carrier's, <br />private club registration, local cartage, storage, <br />and temporary wine and beer retailer's permits: <br /> <br />(2) a wine and beer ~etailer1s permit issued for a <br />dining, buffet or club car: and <br /> <br />(3) a mixed beverage permit during the three-year <br />period following the issuance of the permit. <br /> <br />SECTION 2. That if any word, phrase, sentence, section, <br />or portion of this ordinances is found by a court of <br />competent jurisdiction to be unconstitutional or <br />unenforceable for any reason, the remaining provisions of <br />this ordinance shall remain in effect. <br /> <br />SECTION 3. That all ordinances or parts of ordinances <br />in conflict herewith are hereby repealed. <br /> <br />SECTION 4.
