125 RESOLUTION 1991- 126R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN AMENDED CONTRACT BETWEEN THE CITY AND THE SAN MARCOS CHAMBER OF COMMERCE FOR THE ADMINISTRATION OF FUNDS COLLECTED PURSUANT TO ARTICLE II OF CHAPTER 26 OF THE SAN MARCOS CODE OF ORDINANCES AND AS AUTHORIZED BY CHAPTER 351, TEXAS TAX CODE; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS AMENDED CONTRACT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the State LegiSlature has authorized Texas cities to collect an occupancy tax on hotel and motel rooms and has approved certain expenditures from the proceeds of this occupancy tax in Chapter 351, Texas Tax Code; and, WHEREAS, the City Council of the City of San Marcos has levied a hotel occupancy tax, as enacted in Article II of Chapter 26 of the Code of Ordinances of the City of San Marcos; and, WHEREAS, the City Council wishes to contract with the San Marcos Chamber of Commerce for the administration of a portion of the funds collected from the hotel occupancy tax; and, WHEREAS, the Chamber of Commerce has requested that the contract for this purpose authorized by the City Council on September 9, 1991 be amended with regard to restrictions on purchases made with Convention and Visitors Bureau funds from members of the Convention and visitors Bureau Council; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the annual budget of the San Marcos Chamber of Commerce, a copy of which is attached to the amended contract approved herein is hereby approved. PART 2. That the terms and conditions of the amended Contract for Tourism Promotional Services between the City of San Marcos, Texas, and the San Marcos Chamber of Commerce for the administration of funds collected pursuant to Article II of Chapter 26 of the Code of Ordinances of the City and Chapter 351, Texas Tax Code, a copy of which contract is attached hereto and incorporated herein for all intents and purposes, are hereby approved. PART 3. That the City Manager, Larry D. Gilley, is hereby authorized to execute this contract on behalf of the city of San Marcos. PART 4.
