- 73 -.:s- ~ c:) !~'J ORDINANCE 1991- 76 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 19, PEDDLERS, SOLICITORS, AND ITINERANT MERCHANTS AND VENDORS, OF THE SAN MARCOS CODE OF ORDINANCES TO CHANGE THE NAME OF THE CHAPTER, ADD OR CHANGE DEFINITIONS, AND TO CHANGE THE HOURS DURING tV-HICH SUCH ACTIVITY IS PROHIBITED~ REPEALING ALL LICENSING REQUIREMENTS AND FEES~ PROVIDING FOR SEVERABILITY~ REPEALING ALL CONFLICTING ORDINANCES~ PROVIDING FORA PENALTY~ PROVIDING FOR PUBLICATION~ AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Section 1. That Chapter 19, Peddlers, Solicitors, and Itinerant Merchants and Vendors, of the San Marcos Code of Ordinances is hereby amended to read as follows: Chapter 19 Itinerant Vendors Sec. 19-1. Definitions The following definitions shall apply within this Chapter: ( 1) Goods shall mean any form of tangible personal property. (2) Interstate Commerce shall mean the sale of goods for subsequent delivery by mail or common carrier shipment from a location outside the State of Texas. (3) Itinerant Vendor shall mean any person who goes from house to house or place to place for the purpose of selling goods or services. (4) Sell or selling shall mean any exchange of money for goods or services, including but not limited to, orders involving future payment or delivery. (5) Services shall mean the performance of work or labor, including but not limited to, work or labor furnished in connection with the sale or repair of goods. Sec. 19-2. Prohibition. (a) It shall be unlawful for an itinerant vendor to engage in selling or offers to sell between the hours of 9 p.m. and 8 a.m. (b) It shall be unlawful for any person to engage in selling or offers to sell upon premises where a sign is posted prohibiting such activities, with wording such as "NO SOLICITORS."
