<br />- 73 <br />-.:s- <br />~ <br />c:) <br />!~'J ORDINANCE 1991- <br /> 76 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, AMENDING CHAPTER 19, <br /> PEDDLERS, SOLICITORS, AND ITINERANT MERCHANTS <br /> AND VENDORS, OF THE SAN MARCOS CODE OF <br /> ORDINANCES TO CHANGE THE NAME OF THE CHAPTER, <br /> ADD OR CHANGE DEFINITIONS, AND TO CHANGE THE <br /> HOURS DURING tV-HICH SUCH ACTIVITY IS <br /> PROHIBITED~ REPEALING ALL LICENSING <br /> REQUIREMENTS AND FEES~ PROVIDING FOR <br /> SEVERABILITY~ REPEALING ALL CONFLICTING <br /> ORDINANCES~ PROVIDING FORA PENALTY~ PROVIDING <br /> FOR PUBLICATION~ AND PROVIDING AN EFFECTIVE <br /> DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> Section 1. That Chapter 19, Peddlers, Solicitors, and <br /> Itinerant Merchants and Vendors, of the San Marcos Code of <br /> Ordinances is hereby amended to read as follows: <br /> Chapter 19 <br /> Itinerant Vendors <br /> Sec. 19-1. Definitions <br /> The following definitions shall apply within this <br /> Chapter: <br /> ( 1) Goods shall mean any form of tangible personal <br /> property. <br /> (2) Interstate Commerce shall mean the sale of <br /> goods for subsequent delivery by mail or common <br /> carrier shipment from a location outside the <br /> State of Texas. <br /> (3) Itinerant Vendor shall mean any person who goes <br /> from house to house or place to place for the <br /> purpose of selling goods or services. <br /> (4) Sell or selling shall mean any exchange of <br /> money for goods or services, including but not <br /> limited to, orders involving future payment or <br /> delivery. <br /> (5) Services shall mean the performance of work or <br /> labor, including but not limited to, work or <br /> labor furnished in connection with the sale or <br /> repair of goods. <br /> Sec. 19-2. Prohibition. <br /> (a) It shall be unlawful for an itinerant vendor <br /> to engage in selling or offers to sell between the <br /> hours of 9 p.m. and 8 a.m. <br /> (b) It shall be unlawful for any person to engage <br /> in selling or offers to sell upon premises where a <br /> sign is posted prohibiting such activities, with <br /> wording such as "NO SOLICITORS." <br /> Sec. 19-3 - 19-1Ø Reserved. <br />
