<br /> 75 <br /> RESOLUTION 1991- 157R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, OPPOSING THE STORAGE AND <br /> BURNING OF HAZARDOUS WASTE AS FUEL BY THE <br /> LAFARGE CORPORATION AND THE SYSTECH <br /> ENVIRONMENTAL CORPORATION AT THEIR CEMENT <br /> MANUFACTURING FACILITIES LOCATED IN COMAL OR <br /> HAYS COUNTIES; PROHIBITING THE PURCHASE OF <br /> CEMENT FROM COMPANIES WHO USE HAZARDOUS OR <br /> TOXIC WASTE AS PROCESSING FUEL; AND DECLARING <br /> AN EFFECTIVE DATE. <br /> WHEREAS, the City of San Marcos has the responsibility <br />to protect the health and welfare of its citizens; and, <br /> WHEREAS, the City of San Marcos has determined that it <br />is in the public interest to protect the environmental <br />conditions within the City of San Marcos and its water <br />resources; and, <br /> \vHEREAS, the burning and storage of hazardous waste at <br />the Lafarge Corporation Cement Plants in Comal County or Hays <br />County might detrimentally affect the environment and the <br />health of citizens within a large radius of the plants; and, <br /> WHEREAS, the economics associated with the disposal of <br />hazardous waste are such that the use of hazardous waste as <br />fuel for cement production presents a distinct competitive <br />advantage to companies using such fuel; and, <br /> WHEREAS, the City Council places more value on the <br />possible detrimental effect on the environment of the use of <br />hazardous waste as fuel than any competitive pricing for <br />cement products that might be obtained from companies using <br />such fuel; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> PART 1. That the City opposes the permit applications <br />of Lafarge Corporation/Systech Environmental Corporation for <br />the storage and burning of hazardous waste as fuel in Comal <br />County or in Hays County. <br /> PART 2. That the City shall not purchase raw cement <br />from any company or manufacturer that uses hazardous or toxic <br />waste (as defined by applicable federal or state law) as a <br />fuel in its manufacturing process. <br /> PART 3.
