<br /> 35 <br /> RESOLUTION 1990- 51 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, APPROVING AN EXCHANGE OF RIGHT-OF-WAY <br /> PROPERTY BETWEEN THE CITY OF SAN MARCOS AND JOHN J. <br /> STOKES IN CONNECTION WITH THE RIVER ROAD RECONSTRUCTION <br /> PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE A <br /> QUITCLAIM DEED; REFLECTING RECEIPT OF THE FAIR MARKET <br /> VALUE THROUGH AN EXCHANGE OF PROPERTY FOR EASEMENT <br /> PURPOSES AND DECLARING AN EFFECTIVE DATE. <br /> vJH E REAS, the City of San Marcos desires to make road and drainage <br /> improvements to River Road in San Marcos, Texas, and, <br /> WHEREAS, in order to begin the road and drainage improvements, <br /> right-of-way must be acquired from property owners on River Road; and, <br /> WHEREAS, John J. Stokes owns certain property adjacent to River <br /> Road, and has offered to exchange a portion of his property for <br /> existing City right-of-way; and, <br /> WHEREAS, the City of San Marcos has determined by appraisal that <br /> the value of this property is $200.00 more or less, and the City has <br /> received through an exchange of land for easement purposes an <br /> equivalent value; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That an even exchange of 0.023 of one acre of land within <br /> the J.M. Veramendi League, Survey 2, Abstract l7, City of San Marcos, <br /> Hays County, Texas, belonging to the City of San Marcos for 0.008 of <br /> one acre of land within the J.M. Veramendi League, Survey 2, Abstract <br /> 17, City of San Marcos, Hays County, Texas, belonging to John J. Stokes <br /> of San Marcos, Texas, is hereby approved. <br /> PART 2. That the City Manager of the City of San Marcos, Larry D. <br /> Gilley, is hereby authorized to execute a quitclaim deed conveying to <br /> John J. Stokes the aforementioned 0.023 of one acre tract of <br /> land in exchange for an executed easement for the 0.008 tract of land. <br /> PART 4.
