<br />p <br />~ 54 <br />0-' <br />- <br />- 1990- 56 R <br />r-t"', <br />,",\ ¡ <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE FUTURE LAND USE MAP <br />OF THE MASTER PLAN OF THE CITY, FROM LOW DENSITY <br />RESIDENTIAL AND FLOATING NEIGHBORHOOD COMMERCIAL TO <br />COMMERCIAL FOR BLOCK 1, LOTS 1, 2 AND PART OF LOT 3 OUT <br />OF THE CARROLL/HOFHEINZ ADDITION TO THE CITY OF SAN <br />MARCOS, HAYS COUNTY, TEXAS, LOCATED AT 1320, 1326 AND <br />1402 W. HOPKINS AND DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, on March 20, 1990, the Joint Planning and Zoning <br />Commissions of the City of San Marcos held a public hearing regarding <br />a request to amend the Future Land Use Map of the Master Plan <br />from Low Density Residential and Floating Neighborhood Commercial <br />to Commercial for Block 1, Lots 1, 2 and part of Lot 3 out of the <br />Carroll/Hofheinz Addition, to the City of San Marcos, Hays County, <br />Texas, located at 1320, 1326 and 1402 W. Hopkins Street; and, <br /> <br />WHEREAS, subsequent to the public hearing on that date, the <br />Commissions did, on March 20, 1990, consider the request and <br />voted to approve it and have recommended that the request be <br />approved by the City Council of the City; and, <br /> <br />WHEREAS, the City Council held a public hearing on the 29th day <br />of May, 1990, regarding the request; and, <br /> <br />WHEREAS, all requirements of the Master Plan pertaining to <br />amendments have been met; and, <br /> <br />WHEREAS, the City Council hereby finds and determines that the <br />adoption of the following resolution is in the interest of the public <br />health, morals, welfare and safety; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. That the following described tract of real property <br />located at 1320, 1326 and 1402 West Hopkins Street, San Marcos, Hays <br />County, Texas, which is in an area shown on the Future Land Use <br />Map of the Master Plan of the City of San Marcos as Low <br />Density Residential and Floating Neighborhood Commercial shall be <br />shown on that map as Commercial: <br /> <br />Block 1, Lots l, 2 and part of 3 out of the Carroll/Hofheinz <br />Addition to the City of San Marcos, Hays County as recorded in <br />Volume 50, Page 360 of the Hays County Deed Records; the part <br />of Lot 3 included being described as follows: <br /> <br />Field notes describing a part of Lot 3, of the Carroll/Hofheniz <br />Addition, according to the map or plat thereof recorded in <br />Volume 50, Page 361, Deed Records of Hays County, Texas, and <br />being more particularly described by metes and bounds as <br />follows: <br /> <br />Beginning at a point that marks the South corner of Lot 2, and <br />the East corner of Lot 3, of the afore mentioned <br />CARROLL/HOFHEINZ ADDITION, said point being on the Northwest <br />line of Hopkins Street and also being the East corner of the <br />herein described parcel; <br /> <br />Thence, S 45 degrees W, along the Northwest line of Hopkins <br />Street, a distance of 70' to a point, said point being the South <br />corner of the herein described parcel; <br /> <br />Thence, N 45 degrees W, a distance of ISO' to a point on the <br />Southeast line of Hofheinz Street (an unopened street), said <br />point being the West corner of the herein described parcel; <br /> <br />Thence, N 45 degrees E, along the Southeast line of Hofheinz <br />Street, a distance of 70' to a point, said point being the West <br />corner of Lot 2, the North corner of Lot 3 and the North Corner <br />of the herein described parcel; <br /> <br />Thence, S 45 degrees E, along the common line between Lots 2 and <br />3, a distance of ISO' to a point on the Northwest line of <br />Hopkins Street, said point being the beginning point of this <br />description. <br />
