<br /> 17 <br /> RESOLUTION 1990- 73 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, DETERMINING THAT CERTAIN ORIGINAL POLICE <br /> DEPARTMENT RECORDS OF THE CITY ARE WORTHLESS, DIRECTING <br /> THE CITY MANAGER TO DISPOSE OF THESE RECORDS IN A <br /> MANNER CALCULATED TO DESTROY THEM IN THEIR ENTIRETY, <br /> AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, pursuant to the authority granted by Section 181.005 (a), <br /> Vernon's Annotated Texas Local Government Code as amended, and Section <br /> 2-3(c)(6) of the Code of Ordinances of the City of San Marcos, Texas, <br /> the City Council desires to have certain original Police Department <br /> Records destroyed; and, <br /> WHEREAS, these original records of the City are not the subject <br /> matter of any pending litigation; and, <br /> WHEREAS, authorization for the destruction of these records has <br /> been received from the State Librarian pursuant to Section 181.005(c), <br /> Texas Local Government Code; now, there fore; <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the City Council of the City of San Marcos has <br /> determined that certain original City record s, a list of which is <br /> attached hereto and incorporated herein for all purposes, are <br /> worthless. <br /> PART 2. That the City Manager is hereby authorized and directed <br /> to dispose of these original City records in a manner calculated to <br /> destroy them in their entirety. <br /> PART 3.
