<br />~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, ADOPTING A BUDGET FOR THE FISCAL YEAR
<br />~ BEGINNING ON OCTOBER 1,1990 AND ENDING ON SEPTEMBER 30,
<br />~ 1991, REPEALING ALL ORDINANCES IN CONFLICT WITH THIS
<br />~ ORDINANCE; AUTHORIZING TRANSFERS OF FUNDS WITHIN
<br />c~ DEPARTMENTS WITH THE APPROVAL OF THE CITY MANAGER, AND
<br />~ DECLARING AN EMERGENCY.

<br />
<br />WHEREAS, the Charter of the City of San Marcos, Texas provides
<br />that the City Council shall set a time and place of public
<br />hearing on the proposed budget for the City and shall cause notice
<br />of the hearing and a summary of the budget to be published in
<br />one or more newspapers of general circulation in the City; and,
<br />
<br />WHEREAS, the City Council at its regular meeting on
<br />July 9, 1990, set the date of this hearing and directed the
<br />notice and budget summary be published; and,
<br />
<br />WHEREAS, the notice and budget summary were published in at least
<br />one newspaper of general circulation in the City on July 13, 1990 ,
<br />a date at least ten (10) days prior to the date set for the public
<br />hearing on the budget for the City for the fiscal year beginning
<br />October 1, 1990 and ending September 30, 1991; and,
<br />
<br />WHEREAS, the public hearing on the budget was held on
<br />July 30, 1990 , a time at which all interested persons were given an
<br />opportunity to be heard for or against any item or the amount of any
<br />item contained in the budget; and,
<br />
<br />WHEREAS, at least fourteen (14) days have elapsed since the public
<br />hearing on the budget as required by the City Charter; and, now,
<br />therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS,
<br />TEXAS:
<br />
<br />SECTION 1. That The City of San Marcos Operating and Capital
<br />Budget, Fiscal Year 1990-1991, as shown in words and figures therein
<br />is hereby approved and adopted for the fiscal year beginning October 1,
<br />1990 and ending September 30, 1991.
<br />
<br />SECTION 2. That there is hereby appropriated the amount shown
<br />in the City of San Marcos Operating and Capital Budget, Fiscal Year
<br />1990-1991 necessary to provide for a sinking fund for the payment
<br />of the principal and interest and the retirement of the
<br />bonded debt of the City.
<br />
<br />SECTION 3. That fund transfers among the accounts within each
<br />department, and reclassification of positions within each department,
<br />may be made with the approval of the City Manager.
<br />
<br />SECTION 4. That should any part, portion, or section of this
<br />ordinance be declared invalid or inoperative or void for any
<br />reason by a court of competent jurisdiction, such decision, opinion or
<br />judgment shall in no way affect the remaining portions, parts, or
<br />sections or parts of a section of this ordinance, which provlslons
<br />shall be, remain and continue to be in full force and effect.
<br />
<br />SECTION 5. That all ordinances and appropriations for which
<br />provision has heretofore been made are hereby expressly repealed if in
<br />conflict with the provisions of this ordinance.
<br />
<br />SECTION 6. That the importance of this Ordinance creates an
<br />emergency and an imperative public necessity so that the provisions of
<br />the Charter requiring that ordinances shall be presented at three
<br />separate meetings and that no ordinance shall become effective
<br />until the expiration of ten (10) days following the date of its final
<br />passage, be suspended, and these provisions are hereby suspended,
<br />and this ordinance shall take effect and be in full force and effect
<br />from and after its adoption and after its publication in a newspaper
<br />of general circulation within the City as required by the Charter of
<br />the City of San Marcos, Texas.
