<br /> CY 86 <br /> '" <br /> I.s- <br /> 'c_~ <br /> ORDHPNCE lqQ(ì- ._~- <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AMENDING PORTIONS OF ARTICLE V, CODE OF <br /> ETHICS, OF CHAPTER 2, ADMINISTRATION, OF THE SAN MARCOS <br /> CODE OF ORDINANCES; PROVIDING FOR SEVERABILITY; <br /> REPEALING ALL CONFLICTING ORDINANCES; PROVIDING A <br /> PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN <br /> EFFECTIVE DATE. <br /> WHEREAS, the Ethics Review Commission of the City has completed <br /> its review of Article V, Code of Ethics, of Chapter 2, Administration, <br /> of the San Marcos Code of Ordinances, and has recommended changes to <br /> portions of the Code of Ethics in accordance with Section 12.02 of the <br /> City Charter; and, <br /> WHEREAS, the City Council desires to implement these <br /> recommendations in order to conform the Code of Ethics to recent <br /> amendments to the City Charter, and to changes in State law pertaining <br /> to conflicts of interest of local government officials; now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That Article V, Code of Ethics, of Chapter 2, <br /> Administration, of the San Marcos Code of Ordinances is hereby amended <br /> to read as follows: <br /> ARTICLE V. CODE OF ETHICS <br /> DIVISION 1. GENERALLY <br /> Sec. 2-71. Declaration of policy. <br /> It is the policy of the City of San Marcos that all city <br /> officials and employees shall conduct themselves both inside and <br /> outside the city's service so as to give no occasion for <br /> distrust of their integrity, impartiality or devotion to the <br /> best interest of the City of San Marcos and the public trust <br /> which it holds. To this end and to expressly assure its <br /> accomplishment, the city council hereby establishes a code of <br /> ethics for the City of San Marcos to serve as a guide for <br /> official conduct of the city's public servants, and as a basis <br /> for discipline for those who violate its terms. <br /> Sec. 2-72. Definitions. <br /> For the purposes of this article the following words shall <br /> have these meanings: <br /> Business entity: A Corporation, partnership, sole proprietor- <br /> ship, firm, holding company, joint stock company, receiver- <br /> ship, trust, or any other entity organized for profit. <br /> Employee: Any person employed by the city whether under civil <br /> service regulations or not, including those individuals on a <br /> part-time basis, but not including any independent contractor. <br /> Immediate family: The spouse, children, brothers, sisters <br /> and parents of an officer or employee. <br /> Officer: The mayor or any member of the city council and any <br /> appointive member of a city board, commission or committee set <br /> up by ordinance, charter or state law on a permanent basis. <br />
