<br />I 112 <br />Q:> <br />~ <br />..s- <br /> <br />~ ORDINANCE NO.6 7 <br /> <br />~ <br />ð::= <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, AMENDING <br />SECTION 1-5 OF THE GENERAL PROVISIONS OF <br />THE SAN MARCOS CODE OF ORDINANCES BY <br />INCREASING THE GENERAL PENALTY FOR <br />VIOLATIONS OF THE CODE TO THE MAXIMUM <br />ALLOWED BY STATE LAWr AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br /> <br />BE IT ORDAINED BY THE crry COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Section 1-5 of the General Provisions of the <br />San Marcos Code of Ordinances be amended to read as follows: <br /> <br />Sec. l-S"..__General penalty for violations of coder continuing <br />violations. <br /> <br />(a) A person who violates any provision of this code or any <br />ordinance of the City pertaining to fire safety, zoning <br />or public health and sanitation, including dumping of <br />refuse, shall be punished upon conviction by a fine not <br />to exceed two thousand dollars ($2,ØØØ). <br /> <br />(b) A person who violates any other provision of this code <br />or any other ordinance of the City shall be punished <br />upon conviction thereof by a fine not to exceed five <br />hundred dollars ($SØØ). <br /> <br />(c) Notwithstanding subsections (a) or (b) above, no penalty <br />for a violation shall be greater or less than the <br />penal ty provided for the same or similar offense under <br />the Laws of the State. <br /> <br />(d) Except as otherwise provided in this code or other <br />ordinance, a separate offense shall be deemed committed <br />upon each day on or during which a violation occurs or <br />continues. <br /> <br />SECTION 2. That this Ordinance shall be in effect ten (lØ) <br />days from and after its passage, and it shall be published in a <br />newspaper of general circulation in the area as required by the <br />Charter of the City of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading August 13, 1990. <br /> <br />PASSED AND APPROVED on second reading August 27, 1990. <br /> <br />PASSED, APPROVED AND ADO~.
