<br /> 26 <br /> RESOLUTION 1990- 115 R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF S&~ MARCOS, TEXAS, APPROVING THE TERMS AND <br /> CONDITIONS OF AN AMENDMENT TO THE OPERATING <br /> AGREEMENT i<:!:TWEEN THE CITY AND THE LOWER <br /> COLORADO RIVER AUTHORITY; AUTHORIZING THE CITY <br /> MANAGER TO EXECUTE THE AMENDMENT; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the City and the Lower Colorado River Authority <br /> ("LCRA") entered into an Operating Agreement dated July 24, 1986, <br /> in which LCRA agreed to maintain, operate, replace and extend the <br /> transmission and distribution facilities purchased by the City from <br /> LCRA in a safe, reliable, economic and efficient manner; and, <br /> WHEREAS, the City and LCRA desire to amend this Operating <br /> Agreement with regard to certain portions of it pertaining to its <br /> term and its termination; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the terms and conditions of the Amendment to <br /> Operating Agreement Between the Lower Colorado River Authority and <br /> the City of San Marcos, Texas attached to this Resolution are <br /> hereby approved. <br /> PART 2. That the City Manager, Larry D. Gilley, is hereby <br /> authorized to execute this amendment on behalf of the City. <br /> PART 3. That this Resolution shall be in full force and <br /> effect from and after its passage. <br /> ADOPTED this 24th 1990. <br /> Øt,~ <br />
