J. AND DDESS.A <br />ALLEN ,~ND THE CITY; AUTHORIZING THE CITY <br />!\1ANAGER TO EXECUTE THE AGREE~'1ENT AND RELATED <br />DOCUMENTS: AND DECLARING AN EFFECTIVE DATE. <br /> <br /> <br />NHEREAS, B. J. and Odessa }Ülen (the II Allens ") are th(: <br />owners of property located at 1331 Ranch Road 12, San Marcos, <br />Texas, and have asserted claims against the City pertaining <br />to the presence of electrical lines across the rear portion <br />of that property in Cause No. 88-05CH pending in the 274th <br />State District in Hays County, Texas: and, <br /> <br />V1HEREAS, the ALIens and the City desire to compromise <br />and settle the claims in the suit in accordance "vi th the <br />terms of th(~ agreement attached to this Resolution: now, <br />therefore, <br /> <br />BE rf RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />f\1ARCOS, TEXAS: <br /> <br />PART 1. That the terms and conditions of the settlement <br />agreement between the lUlens and the City attached to this <br />Resolution pertaining to Cause No. 88-ØSCJl pending in the <br />274th State District Court are hereby approved. <br /> <br />PART 2. That the City Manager, Larry D. Gilley is <br />authorized to execute the settlement agreement, together with <br />all related documents and inst:çuments, on behalf of the City. <br /> <br />PART 3. That this Resolution shall be in full force and <br />effect i~mediately from and after its passage. <br /> <br />ADOPTED this the 24th September, 192Q. <br /> <br /> <br />.1.
