<br /> 23 <br /><) ORDINANCE 1990- 97 <br />cr-' <br />(ï" <br />.- AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />- <br />~ OF SAN MARCOS, TEXAS, PROVIDING FOR ISSUANCE <br />- <br /> OF A PERMIT FOR CERTAIN ALARM SYSTEMS; <br /> PROVIDING FOR SERVICE FEES FOR CITY RESPONSES <br /> TO EXCESSIVE FALSE ALARMS; PROVIDING FOR <br /> REVOCATION OF PERMITS; PROVIDING STANDARDS FOR <br /> ALARM PROTECTIVE SERVICES AND ALARM SYSTEM <br /> OPERATION; PROVIDING FOR SEVERABILITY; <br /> REPEALING ALL CONFLICTING ORDINANCES; <br /> PROVIDING A PENALTY; PROVIDING FOR <br /> PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That Chapter 16, Miscellaneous Offenses and <br /> Provisions, of the San Marcos Code of Ordinances is hereby amended <br /> by adding Article V, Alarm Systems, to read as follows: <br /> ARTICLE V. ALARM SYSTEMS <br /> Sec. 16-63. Definitions. <br /> For the purposes of this Article the following <br /> definitions shall apply unless the context requires a <br /> different definition: <br /> (I) Alarm ~rotective service shall mean any <br /> service involving the installation, servicing, <br /> repair, maintainance, sale, replacement, or <br /> response to an. alarm system. For the purposes <br /> of this Article, alarm protective service <br /> shall not include any persons engaged solely <br /> in the sale of alarm systems designed to cause <br /> an audible and/or visual signal to be emitted <br /> only in or on the premises in which the system <br /> is installed. <br /> (2) Alarm site shall mean a single premises or <br /> location (one street address) served by an <br /> alarm system or systems that are under the <br /> control of one owner. <br /> (3) Alarm system shall mean any assembly of <br /> equipment, device or devices arranged to <br /> signal the presence of a hazard requiring <br /> urgent attention and to which Police or Fire <br /> Department Personnel are expected to respond. <br /> The term alarm system shall include the terms <br /> automatic holdup alarm system, burglar alarm <br /> system, holdup alarm system, manual holdup <br /> alarm system, fire alarm system, as those <br /> terms are hereinafter defined. <br /> For the purposes of this Article an alarm <br /> system shall not include: <br /> (A) An alarm system installed upon premises <br /> occupied by the united States Government, <br /> the State of Texas, the City of San <br /> Marcos, or any county government or <br /> school districts situated within the <br /> city; <br /> (B) An alarm system installed on a motor <br /> vehicle; or <br />
