<br /> 88 <br /> RESOLUTION 1989-24R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, SUPPORTING LEGISLATION PROVIDING FOR THE <br /> RECOGNITION AND LIMITATION OF GROUNDWATER FROM THE <br /> EDWARDS AQUIFER AND AUTHORIZING THE TEXAS WATER <br /> COMMISSION TO MAKE AND ENFORCE RULES FOR SUCH RIGHTS, <br /> AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the Edwards Aquifer is the sole source of water for this <br />region; and, <br /> WHEREAS, the continuous and sustained withdrawal of groundwater <br />from the Edwards Aquifer in excess of the average annual recharge will <br />do substantial injury to the Edwards Aquifer and the general economy <br />and welfare of this City; and, <br /> WHEREAS, legislation is needed to provide for the recogni tion and <br />limitation of groundwater rights from the Edwards Aquifer, to authorize <br />and direct the Texas Water Commission to make and enforce rules for the <br />determination of such rights, to provide for the issuance of <br />certificates and permits, and to provide for the administration of all <br />such rights and matters related thereto; and, <br /> WHEREAS, it is in the interest of the City of San Marcos and <br />consistent with the City's goal of conserving and protecting the <br />Edwards Aquifer to approve and support the passage of such legislation <br />by the 71st Texas Legislature; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> PART 1. That the City hereby supports legislation recogni zing and <br />limiting groundwater rights from the Edwards Aquifer, authorizing and <br />directing the Texas Water Commission to make and enforce rules for the <br />determination of groundwater rights from the Edwards Aquifer, providing <br />for the issuance of certificates and permits, and providing for the <br />administration of all such rights and matters related thereto. <br /> PART 2. That said City hereby encourages, approves and supports <br />efforts and activities to secure the passage of such legislation by the <br />71st Texas Legislature. <br /> PART 3. That the Mayor and the City Manager are hereby authorized <br />and directed to take such actions, in close cooperation with <br />other governmental entities and agencies, as are appropriate to <br />inform members of the Texas Legislature and other appropriate officials <br />and persons of the City's approval and support of such <br />legislation. <br /> PART 4.
