<br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING THE FUTURE LAND USE PLAN (MAP)
<br />OF THE MASTER PLAN OF SAID CITY, OF 1.20 ACRE, MORE
<br />OR LESS, OF LAND AREA IN THE J.M. VERAMENDI LEAGUE NO.1
<br />IN SAN MARCOS, HAYS COUNTY, TEXAS, BEING THOSE TWO TRACTS
<br />OF LAND DESCRIBED IN A DEED FROM BARBARA JEAN MOSS TO HELEN
<br />B. MOTT DATED SEPTEMBER 20, 1969 AND RECORDED IN VOLUME
<br />233, PAGE 107, AND BEING THAT TRACT OF LAND DESCRIBED IN
<br />A DEED FROM ELIZABETH B. SCHNAUTZ TO HELEN B. MOTT DATED
<br />JULY 23,1973 AND RECORDED IN VOLUME 260, PAGE 535 OF THE
<br />HAYS COUNTY DEED RECORDS, SAN MARCOS, TEXAS, LOCATED AT
<br />1804 HUNTER ROAD FROM PERMANENT OPEN SPACE/FLOOD PLAIN
<br />TO COMMERCIAL; AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on February 21,1989, the Joint Planning and Zoning
<br />Commissions of the City of San Marcos heid a public hearing regarding
<br />a request to amend the Future Land Use Plan (Map) of the Master
<br />Plan from Permanent Open Space/Flood Plain to Commercial of 1.20 acres
<br />of land out of the J.M. Veramendi Survey No.1, located at 1804
<br />Hunter Road, San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commissions did, on February 21, 1989, consider said request
<br />and voted to approve the same and have recommended that
<br />such request be approved by the City Council of said City; and,
<br />
<br />WHEREAS, said City Council held a public hearing on the 10 day
<br />of July, 1989, regarding such request; and,
<br />
<br />WHEREAS, all requirements of the Master Plan pertaining to
<br />amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following resolution is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />PART 1. That the following described tract of real property
<br />located at 1804 Hunter Road, San Marcos, Hays County, Texas, which
<br />is in an area shown on the Future Land Use Plan (Map) of the Master
<br />Plan of the City of San Marcos as Permanent Open Space/
<br />Flood Plain shall be shown on said map as Commercial District:
<br />
<br />DESCRIPTION OF 1.20 ACRE, MORE OR LESS, OF LAND AREA IN THE J.M.
<br />VERAMENDI LEAGUE NO.1 IN SAN MARCOS, HAYS COUNTY, TEXAS,
<br />BEING THOSE TWO TRACTS OF LAND DESCRIBED IN A DEED FROM
<br />BARBARA JEAN MOSS TO HELEN B. MOTT DATED SEPTEMBER 20,1969 AND
<br />RECORDED IN VOLUME 233, PAGE 107, AND BEING THAT TRACT OF
<br />LAND DESCRIBED IN A DEED FROM ELIZABETH B. SCHNAUTZ TO HELEN B.
<br />MOTT DATED JULY 23, 1973 AND RECORDED IN VOLUME 260, PAGE 535 OF
<br />THE HAYS COUNTY DEED RECORDS, AND BEING MORE PARTICULARLY
<br />DESCRIBED BY METES AND BOUNDS AS FOLLOWS:

<br />
<br />BEGINNING at an iron rod found for the south corner of the
<br />aforereferenced Mott tract, for the east corner of that tract of
<br />land described in a deed from Bob Reed, et ux, to Tommy Sharp,
<br />et ux, dated May 20, 1953 and recorded in Volume 152, Page 181
<br />of the Hays County Deed Records in the apparent northwest line
<br />of Old Post Road for the south corner of this tract;
<br />
<br />THENCE leaving the PLACE OF BEGINNING and Old Post Road with the
<br />common line of the Mott tract and the Sharp tract N45 degrees
<br />OO'W 208.12 feet to an iron rod found for the north corner of
<br />the Sharp tract and a east corner of a remainder of that 39.1
<br />acre tract of land described in a deed from R.E. Mckie to Henry
<br />Netherland dated August 23, 1946 and recorded in Volume 135,
<br />Page 617 of the Hays County Deed Records;
<br />
<br />THENCE leaving the Sharp tract with the common line of the Mott
<br />tract and the Netherland remainder tract N45 degrees 07'48"W
<br />67.99 feet to an iron rod found for the west corner of the Mott
<br />tract and the south corner of that tract of land described in a
<br />deed from Elizabeth Schnautz to Shirley L. Tuttle, et ux, dated
<br />June 30, 1978 and recorded in Volume 312, Page 380 of the Hays
<br />County Deed Records;
