<br /> 93 <br /> RESOLUTION 1989-67R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING THE TERMS AND CONDITIONS OF <br />A MUNICIPAL MAINTENANCE AGREEMENT BETWEEN SAID CITY <br />AND THE STATE OF TEXAS FOR EllTURE INSTALLATION, <br />OPERATION, AND MAINTENANCE OF CERTAIN HIGHWAY <br />TRAFFIC SIGNALS IN SAID CITY, AUTHORIZING THE MAYOR <br />TO EXECUTE SAID AGREEMENT AND DECLARING AN <br />EFFECTIVE DATE. <br />WHEREAS, the City of San Marcos from time to time <br />requests that the State install traffic signals on certain <br />highways within the City; and, <br />WHEREAS, under the provisions of Title 43, Texas <br />Administrative Code, Section 25.5, the State has the <br />authority to install, operate and maintain traffic signals on <br />freeway type highways in all cities and on other highway <br />routes in cities with a population of less than 50,000 <br />according to the latest Federal Census; and, <br />WHEREAS, the City has a population of less than 50,000 <br />according to the latest Federal Census; now, therefore, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />Part 1. That the terms and conditions of that <br />Municipal Maintenance Agreement between the City of San <br />Marcos and the State of Texas for the future installation, <br />operation and maintenanëe of certain highway traffic signals <br />in said City, a copy of which is attached to this resolution <br />and made a part of it for all pu~poses, are hereby approved. <br />Part 2. That the Mayor of the City of San Marcos, <br />Kathy M. Morris, be, and she is hereby, authorized to execute <br />said Agreement on behalf of said City. <br />Part 3.
