164 ORDINANCE 1989- 71 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AHENDING SECTION 2-43 OF THE CODE OF ORDINANCES OF THE CITY TO CONFIRM THE DATE ON WHICH CALCULATIONS OF UPDATED SERVICE CREDITS ARE BASED UNDER THE ACT GOVERNING THE TEXAS MUNICIPAL RETIREMENT SYSTEM FOR SERVICE PERFORMED BY QUALIFYING MEMBERS OF THE SYSTEM IN THE EMPLOYMENT OF THE CITY, AND TO CHANGE THE DATE ON NHICH CALCULATIONS OF UPDATED SERVICE CREDITS ARE BASED UNDER THE ACT FOR SERVICE PERFORMED BY QUALIFYING MEHBERS OF THE SYSTEM NHO HAVE UNFORFEITED CREDIT FOR PRIOR SERVICE AND/OR CURRENT SERVICE WITH OTHER PARTICIPATING MUNICIPALITIES BY REASON OF PREVIOUS SERVICE AND ~'VHO \iifERE CONTRIBUTING MEMBERS ON JANUARY 1, 1989; AMENDING SECTION 2-44(b) OF THE CODE OF ORDINANCES TO CHANGE THE DATE ON WHICH CALCULATIONS OF THE INCREASE IN RETIREMENT ANNUITIES ARE BASED; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the date of "the first day of January, 1989" presently contained within subsection (a) of Section 2-43 of the Code of Ordinances of the City of San Marcos is hereby confirmed and approved. SECTION 2. That Section 2-43 of the Code of Ordinances of the City of San Harcos, Texas, is hereby amended to change the date of January 1, 1988 in subsection (b) thereof to January 1, 1989. SECTION 3. That Section 2-44(b) of Division 2 of Article III of Chapter 2 of the Code of Ordinances of the City of San Marcos, Texas, is hereby amended to change the date of January 1, 1989 therein to January 1, 1990. SECTION 4. That the importance of this Ordinance creates an emergency and an imperative public necessity so that the provisions of the Charter requiring that ordinances shall be presented at three separate meetings and that no ordinance shall become effective until the expiration of ten (10) days following the date of its final passage be suspended, and these provisions are hereby suspended, and this Ordinance shall take effect on January 1, 1990 and after its publication in a newspaper of general circulation within the City as provided by the City Charter of the City of San Marcos, Texas.
