<br />AN ORnIN~NCR OP THR CITY COUNCIL OP THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING LOTS 217 THROUGH 223 AND 280 THROUGH 284 OF BLOCK
<br />23, OF THE WESTOVER ADDITION TO THE CITY OF SAN MARCOS,
<br />HAYS COUNTY, TEXAS, AS RECORDED IN VOLUME 59, PAGE 184
<br />OF THE DEED RECORDS OF HAYS COUNTY, TEXAS, LOCATED AT
<br />1100 THROUGH 1112 DARTMOUTH STREET AND 1101 THROUGH 1109
<br />BI SHOP STREET FROM IIR-l" (SINGLE-FAMI LY DWELLING DISTRICT-
<br />LOW DENSITY) TO IIDP-11I (DUPLEX DISTRICT-LOW DENSITY); AND
<br />DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on November 3,1987 the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to change the
<br />zoning from "R-11I (Single Family Dwelling District-Low Density) to
<br />IIDP-11I (Duplex District-Low Density) of Lots 217 through 223 and 280
<br />through 284 of Block 23, of the Westover Addition, to the City of San
<br />Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS,

<br />subsequent to said public hearing on said date, said
<br />did, on November 3, 1987, consider said request and
<br />approve the same and has recommended that such
<br />approved by the City Council of said City;
<br />
<br />WHEREAS, said City CouRcil held a public hearing on the
<br />of January , 1988, reg arding such reques t; and,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />II R-l" ( Sing le-Fami ly Dwe 11 ing Dis trict- Low Dens i ty) be rezoned
<br />"DP-l" (Duplex District):
<br />
<br />LOTS 217 THROUGH 223 AND 280 THROUGH 284 OF BLOCK 23, OF THE
<br />WESTOVER ADDITION TO THE CITY OF SAN MARCOS, HAYS COUNTY,
<br />TEXAS, AS RECORDED IN VOLUME 59, PAGE 184 OF THE DEED RECORDS
<br />OF HAYS COUNTY, TEXAS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on January 25, 1988, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this II day of January
<br />subject to reconsideration at the next regular City Council
<br />scheduled for January 25, 1988
