<br />AN ORDIN~NCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING LOTS 1, lA, 2,3 AND 4 OF SB & K JOINT VENTURE
<br />SUBDIVISION, SECTION 1, SAN MARCOS, HAYS COUNTY, TEXAS,
<br />AS RECORDED IN VOLUME 4, PAGE 277 OF THE DEED RECORDS
<br />OF HAYS COUNTY, TEXAS, LOCATED ON THE SOUTH SIDE OF UHLAND
<br />ROAD, EAST OF IH 35 FROM "c" (COMMERCIAL DISTRICT) TO "LI"
<br />(LIGHT INDUSTRIAL DISTRICT); AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on November 17,1987 the Zoning Commission of the
<br />San Marcos held a public hearing regarding a request to
<br />the zoning from "c" (Commercial District) to "LI"
<br />Industrial District) of Lots 1, lA, 2, 3 and 4 of SB & K Joint
<br />Subdivision, Section 1, to the City of San Marcos, Hays County,
<br />and,
<br />

<br />
<br />WHEREAS,
<br />Commission
<br />voted to
<br />request be
<br />and,
<br />
<br />subsequent to said public hearing on said date, said
<br />did, on November 17, 1987, consider said request and
<br />approve the same and has recommended that such
<br />approved by the City Council of said City;
<br />
<br />WHEREAS, said City Council held a public hearing on the
<br />of January, 1988, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />"c" (Commercial District) be rezoned "LI" (Light Industrial District):
<br />
<br />LOTS 1, lA, 2, 3 AND 4 OF SB & K JOINT VENTURE
<br />SUBDIVISION, SECTION 1, SAN MARCOS, HAYS COUNTY, TEXAS,
<br />AS RECORDED IN VOLUME 4, PAGE 277 OF THE DEED RECORDS
<br />OF HAYS COUNTY, TEXAS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered onJanuary 25, 1988, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this II day of January
<br />subject to reconsideration at the next regular City Council
<br />scheduled for January 25, 1988
