<br />AN ORDINANCE OR THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGU LATES AND RESTRICTS THE LOCATION AND USE OF BUI LDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING A PART OF LOT C IN BLOCK NO. ONE (1) OF THE B.vJ.
<br />BREEDING ADDITION, CITY OF SAN MARCOS, HAYS COUNTY,
<br />TEXAS, ACCORDING TO THE PLAT THEREOF RECORDED IN BOOK 0,
<br />PAGE 202 OF SAID HAYS COUNTY DEED RECORDS, LOCATED AT 708
<br />CENTER STREET FROM "M" (SINGLE-FAMILY, DUPLEX, AND
<br />NEIGHBORHOOD BUSINESS DISTRICT) TO TO "R-2" (SINGLE FAMI LY
<br />DWELLING DISTRICT-MEDIUM DENSITY); AND DECLARING AN
<br />EFFECTIVE DATE.
<br />
<br />WHEREAS, on December 1,1987 the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to change the
<br />zoning from "M" (Single-Family, Duplex and Neighborhood
<br />Business District) to "R-2" (Single Family Dwelling District-Medium
<br />Density) of a part of Lot C in Block No. One (1) of the B.W. Breeding
<br />Addition, to the City of San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS,
<br />Commission
<br />voted to
<br />request be
<br />and,
<br />
<br />subsequent to said public hearing on said date, said
<br />did, on December 1, 1987, consider said request and
<br />approve the same and has recommended that such
<br />approved by the City Council of said City;
<br />
<br />WHEREAS, said City Council held a public hearing on the
<br />of February, 1988, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; npw, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
<br />
<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned "M" (Single-Family, Duplex and Neighborhood Business District)
<br />be rezoned "R-2" (Single Family Dwelling District-Medium Density):
<br />
<br />All that certain real property situated in the City of San
<br />Marcos, in Hays County, Texas, a part of lot C in Block No. One
<br />(1) of the B.W. Breeding Addition to said City, according to the
<br />plat thereof recorded in Book 0, page 202 of said Deed Records,
<br />and the portion of said Lot conveyed hereby is described by
<br />metes and bounds as follows:
<br />
<br />BEGINNING at the most Eastern corner of said lot C and the most
<br />Southern corner of lot B in said Block on the Northwestern line
<br />of Centre Street;
<br />
<br />THENCE with the common line of Lots C and B, N. 45 degrees W.
<br />166-2/3 feet, more or less, to the Northern corner of said Lot
<br />C;
<br />
<br />THENCE with the Northwestern line of said Lot C, S. 45 degrees
<br />W. 56 feet for the most Western corner of the property conveyed
<br />hereby;
<br />
<br />THENCE S. 45 degrees E. 166-2/3 feet, more or less, to the
<br />Northwestern line of Centre Street and at right angles to the
<br />line of said Street;
<br />
<br />THENCE N. 45 degrees E. with the Northwestern line of said
<br />Centre Street 56 feet to the place of beginning, thus conveying
<br />hereby a strip of land 56 feet wide off of the Northeastern side
<br />of said Lot C.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on February 22, 1988, it shall be in effect ten
