<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE OHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING DOTS 3 AND 4, BLOCK 17 IN THE ORIGINAL TOWN OF SAN
<br />MARCOS, CITY OF SAN MARCOS, HAYS COUNTY, TEXAS, AS
<br />RECORDED IN VOLUME 1, PAGE 20 OF THE HAYS COUNTY PLAT
<br />RECORDS LOCATED AT 316 W. HOPKINS STREET FROM "C"
<br />(COMMERCIAL DISTRICT) TO "OPff (OFFICE AND PROFESSIONAL
<br />DISTRICT); AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on January 5,1988 the Zoning Commission of the City
<br />San Marcos held a public hearing regarding a request to change
<br />zon ing from "c" ( Commerc ia 1 District) to "OP II (Office
<br />Professional District) of Lots 3 and 4, Block 17 in the Original
<br />of San Marcos, to the City of San Marcos, Hays County, Texas;

<br />and,
<br />
<br />WHEREAS,
<br />Commission
<br />voted to
<br />request be
<br />and,
<br />
<br />subsequent to said public hearing on said date, said
<br />did, on January 5,1988, consider said request and
<br />approve the same and has recommended that such
<br />approved by the City Council of said City;
<br />
<br />WHEREAS, said City Council held a public hearing on the
<br />of February, 1988, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real próperty
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned "C" (Commercial District) be rezoned "Op" (Office
<br />and Professional District):
<br />
<br />LOTS 3 AND 4, BLOCK 17 IN THE ORIGINAL TOWN OF SAN MARCOS, CITY
<br />OF SAN MARCOS, HAYS COUNTY, TEXAS, AS RECORDED IN VOLUME 1,
<br />PAGE 20 OF THE HAYS COUNTY PLAT RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on March 7, 1988, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 22 day of February
<br />subject to reconsideration at the next regular City Council
<br />scheduled for March 7, 1988
