ORDINANCE 2009 - 10 <br />AN ORDINANCE OFTHE CITYCOUNCILOFTHE CITYOF <br />SAN MARCOS, TEXAS AMENDING THE TRAFFIC <br />REGISTER MAINTAINED UNDER SECTION 82.067 OF THE <br />SAN MARCOS CITY CODE BY AMENDING THE SPEED <br />LIMITS, INCLUDING THE ADDITION OF A SCHOOL ZONE <br />SPEED LIMIT, ALONG CERTAIN SECTIONS OF S.H. 123 <br />BOTH DIRECTIONSFROMAPOINTNORTHOFFM621 TO <br />A POINT SOUTH OF MONTEREY OAKS; PROVIDING A <br />SAVINGS CLAUSE; PROVIDING THATALL CONFLICTING <br />ORDINANCES ARE REPEALED; AND PROVIDING AN <br />EFFECTIVE DATE. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Pursuant to Sections 82.003 and 82.066 of the City Code, on the basis <br />of an engineering and traffic investigation performed by the Texas Department of <br />Transportation finding that the current state maximum speed limit is unreasonable, the <br />traffic register maintained under Section 82.067 of the CityCode is amended byadding the <br />following speed limits in the locations described: <br />a. S.H. 123, both directions, from a point 1520 feet north of F.M. 621 to <br />Ebony Street, a prima facie maximum speed limit of 40 miles per hour; <br />b. S.H. 123, both directions, from Ebony Street to a point 739 feet south <br />of De Zavala, a prima facie maximum speed limit of 45 miles per hour; <br />c. S.H. 123, both directions, from a point 739 feet south of De Zavala to <br />F.M. 3407, a prima facie maximum speed limit of 55 miles per hour; and, <br />d. S.H. 123, both directions, from F.M. 3407 to a point 581 feet south of <br />Monterey Oaks, a prima facie speed of 60 miles per hour. <br />e. S.H. 123, both directions, from Monterey Oaks to a point 582 south of <br />Monterey Oaks, a prima facie speed of 65 miles per hour. <br />SECTION 2. Pursuant to Sections 82.003 and 82.066 of the City Code the traffic <br />register maintained under Section 82.067 of the City Code is amended by adding the <br />following school zone speed limits in the locations described: <br />a. S.H. 123, both directions, beginning at a point 260 feet north of <br />Broadway to a point 200 feet south of De Zavala a prima facie speed limit of 30 <br />miles per hourwhen flashing, and 45 miles per hour, as posted, at all other times.
