ORDINANCE 2010 -66 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, CANVASSING RETURNS AND DECLARING RESULTS <br />OF THE GENERAL AND SPECIAL ELECTION, HELD ON NOVEMBER 2, <br />2010, FOR THE PURPOSE OF ELECTING A MAYOR, CITY COUNCIL <br />MEMBER, PLACE 1, CITY COUNCIL MEMBER, PLACE 2, AND TO FILL <br />A VACANCY FOR THE REMAINDER OF THE TERM OF OFFICE OF CITY <br />COUNCIL MEMBER PLACE 6; SUBMITTING A PROPOSED AMENDMENT <br />TO THE CITY CHARTED_ PERTAINING TO THE APPOINTMENT OF A. <br />CITY INTERNAL CITY AUDITOR AND A PROPOSITION TO LEASE CITY <br />PARK PROPERTY TO THE SAN MARCOS NOON LIONS CLUB TO THE <br />VOTERS; AND DECLARING AN EMERGENCY. <br />RECITALS: <br />1. On August 17, 2010 the City Council ordered that a General and Special Election be <br />held on November 2, 2010 for the purpose of electing a Mayor, a City Council Member, Place 1, <br />a City Council Member, Place 2, and to fill a vacancy for the remainder of the term of office of <br />City Council Member Place 6; submitting a proposition regarding an amendment to the City <br />Charter permitting the City Council to appoint a city internal auditor, and a propostion to <br />• authorize the lease of a portion of City Park property to the San Marcos Noon Lions Club for a <br />tube rental operation to the voters. <br />2. The election was duly and legally held on November 2, 2010, in conformity with the <br />election laws of the State of Texas, and the results of the election have been certified and <br />returned by the proper judges and clerks. <br />3. The City Council of the City of San Marcos, Texas convened to consider the returns of <br />the General and Special election held on November 2, 2010 with the following members present: <br />Susan Narvaiz, Kim Porterfield, Gaylord Bose, Ryan Thomason, Fred Terry, and Chris Jones. <br />4. It appears to the Council, and the Council finds, that the election was in all respects <br />lawfully held. <br />5. It appears to the Council, and Council finds, that the tabulation of the results of the <br />election is correct. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />• <br />
