<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS, ABANDONING AND VACATING A PORTION OF A
<br />SIXTEEN FOOT (16') WIDE ALLEY, AND BEING THAT PORTION
<br />WHICH ABUTS LOTS 33 AND 34 OF THE SECOND DIVISION OF
<br />PARK ADDITION IN SAID CITY; AUTHORIZING THE MAYOR OF
<br />SAID CITY TO EXECUTE SPECIAL WARRANTY DEEDS;
<br />REFLECTING PAYMENT OF THE FAIR MARKET VALUE OF $180.00;
<br />AND DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, a portion of an alley sixteen (16) feet in width, said
<br />portion abutting Lots 33 and 34 of the Second Division of Park Addition
<br />To The City of San Marcos, the plat of said addition recorded in Volume
<br />54, Page 420, Hays County Deed Records, as shown on said plat; was and
<br />is dedicated to public use on the plat of said Addition of record
<br />in Volume 54, Page 420 of the Deed Records of Hays County, Texas;
<br />and,
<br />
<br />WHEREAS, the City of San Marcos has been requested by Wiliam
<br />Randolph Rogers and Sally J. Ploeger to abandon said portion of
<br />said alley; and,
<br />
<br />vffiEREAS, the City of San Marcos has duly determined that William
<br />Randolph Rogers and wife, Tamara Jean Rogers, and Sally J. Ploeger,
<br />are the sole owners of all property abutting said portion of said alley
<br />within said Second Division Of Park Addition; and,
<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas, has
<br />determined that it is in the public interest to abandon said portion of
<br />said alley; and,
<br />
<br />WHEREAS, the said William Randolph Rogers, Tamara Jean Rogers and
<br />Sally J. Ploeger have executed releases, discharging said City from
<br />any damages occasioned by said vacation and abandonment; and,
<br />
<br />WHEREAS, the City of San Marcos has determined by appraisal that
<br />the fair market value of said property is $180.00 and the same has
<br />previously been deposited with said City; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY

<br />SECTION 1. That a portion of an alley sixteen (16) feet in
<br />width, and being that portion which abuts Lots 33 and 34 of the Second
<br />Division Of Park Addition To The City of San Marcos, the plat of said
<br />subdivision recorded in Volume 54, Page 420, Deed Records of Hays
<br />County, Texas, be, and it is hereby declared to be, and is henceforth,
<br />vacated and abandoned as to any use, right, claim in, or responsibility
<br />for the upkeep and maintenance by the public in general and the City of
<br />San Marcos in particular.
<br />
<br />SECTION 2. That the Mayor of the City of San Marcos, Texas, be,
<br />and she is hereby, authorized to execute special warranty deeds
<br />conveying to William Randolph Rogers and Tamara Jean Rogers, and Sally
<br />J. Ploeger, one-half (1/2) of the width of said portion of said alley
<br />which abuts their respective properties.
<br />
<br />SECTION 3. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage, and it shall be published in a newspaper of
<br />general circulation in the area as required by the Charter of the City
<br />of San Marcos, Texas.
