<br /> <br /> <br /> <br />BE <br /> <br />IT <br /> <br />37 <br /> <br />ORDINANCE 1987-18 <br /> <br />AN ~~DINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, N~ENDING ORDINANCE NO. 1986-85, THE <br />UTILITY DISTRICT ORDINANCE, ADOPTED BY THE CITY COUNCIL <br />OF THE CITY OF SAN MARCOS ON JULY 21,1986, BY DELETING <br />PART E, SECTION 2A(2) WHICH PROVIDES THAT "CURBS, <br />GUTTERS, INLETS, CULVERTS AND BRIDGESI1 SHALL NOT BE <br />FINANCED BY THE ISSUANCE OF MUNICIPAL UTILITY DISTRICT <br />BONDS; BY DELETING PART E, SECTION 2A(3) WHICH PROVIDES <br />THAT DRAINAGE IMPROVEMENTS SHALL NOT BE FINANCED BY THE <br />ISSUANCE OF MUNICIPAL UTILITY DISTRICT BONDS; AMENDING <br />PART E, SECTION 3G BY DELETING THE PROVISION THAT <br />REQUIRES THAT liTHE CITY COUNCIL SHALL HAVE THE RIGHT OF <br />APPROVAL OF ALL BOND ISSUES AND SALES" AND SUBSTITUTING <br />THEREFOR A PROVISION THAT GIVES THE CITY COUNCIL THE <br />RIGHT OF REVIEW ONLY OF ALL BOND ISSUES AND SALES; <br />AMENDING PART E SECTION 3A WHICH PROVIDES THAT "ALL <br />DEVELOPMENT ACTIVITIES WITHIN THE UTILITY DISTRICT SHALL <br />CONFORM TO ALL CITY OF SAN MARCOS ORDINANCE REQUIREMENTS" <br />AND SUBSTITUTING THEREFOR A REQUIREMENT THAT ALL <br />DEVELOPMENT ACTIVITIES WITHIN THE UTILITY DISTRICT <br />SHALL CONFORM TO THE SUBSTANTIVE ASPECTS OF ALL CITY OF <br />SAN MARCOS ORDINANCE REQUIREMENTS; DECLARING AN <br />EMERGENCY AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />ORDAINED <br /> <br />BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That Part E, Section 2A(2) of the Utility District <br />Ordinance, No. 1986-85, which provides that "curbs, gutters, inlets, <br />culverts, and bridges" shall not be allowed to be financed by the <br />issuance of municipal utility district bonds is hereby deleted. <br /> <br />SECTION 2. That Part E, Section 2A(3) of the Utility District <br />Ordinance, No. 1986-85, which provides that I1drainage improvement, <br />except storm sewers and regional facilities" shall not be allowed to be <br />financed by the issuance of municipal utility district bonds is hereby <br />deleted. <br /> <br />SECTION 3. That Part E, Section 3G of the Utility District <br />Ordinance, No. 1986-85, which provides that the City Council shall have <br />the right of approval of all bond issues and sales be amended to <br />provide that the City Council shall have the right of I1review" of all <br />bond issues and sales. <br /> <br />SECTION 4. That Part E, Section3A of the Utility District <br />Ordinance, No. 1986-85, which provides that l1all development activities <br />within the Utility District shall conform to all City of San Marcos <br />ordinance requirements in existence on the date of approval of the <br />creation petition by the City Council" shall be amended to read as <br />follows: <br /> <br />"All development activities within the Utility District shall <br />conform to all of the substantive aspects of all City of San <br />Marcos Ordinance requirments in existence on the date of approval <br />of the creation petition by the City Council." <br /> <br />SECTION 5. That the importance of this Ordinance creates an <br />emergency and an imperative public necessity so that the provisions of <br />the Charter requiring that ordinances shall be presented at three <br />separate meetings and that no ordinance shall become effective until <br />the expiration of ten (10) days following the date of its final passage <br />be suspended, and these provisions are hereby suspended, and this <br />Ordinance shall take effect and be in full force and effect from and <br />after its adoption and after its publication in a newspaper of general <br />circulation within the City as provided by the City Charter of the City <br />of San Marcos. <br /> <br />1987.
