<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />~1ARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING BLOCK 29, LOTS 487-490; BLOCK 30, LOTS 481-486;
<br />BLOCK 33, LOTS 511-516; BLOCK 34, LOTS 505-510 AND 543-548
<br />OUT OF THE WESTOVER ADDITION TO THE CITY OF SAN MARCOS AS
<br />RECORDED IN VOLUME 59, PAGES 184-185 IN THE HAYS COUNTY
<br />DEED RECORDS; LOCATED ALONG THE 900 AND 1000 BLOCKS OF
<br />HAZELTON, THE 1000 BLOCK OF HILLYER AND THE 1000 AND 1100
<br />BLOCKS OF GIRARD STREET FROM "DP-2" (DUPLEX DISTRICT-
<br />MEDIUM DENSITY) TO "DP-1 (DUPLEX DISTRICT -LOW DENSITY);
<br />AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, on December 2, 1986, the Zoning Commission of the City
<br />of San Marcos held a public hearing regarding a request to change
<br />the zoning from "DP-2" (Duplex District-Medium Density) to "DP-1"
<br />(Duplex District-Low Density) of Block 29, Lots 487-490; Block 30,
<br />Lots 481-486; Block 33, Lots 511-516; Block 34, Lots 505-510 and
<br />543-548 out of the Westover Addition to the City of San Marcos, Hays
<br />County, Texas; and,
<br />
<br />WHEREAS, subsequent to said public hearing on said date, said
<br />Commission did, on December 2, 1986, consider said request
<br />and voted to approve the same and has recommended that such request
<br />be approved by the City Council of said City; and,
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />February, 1987, regarding such request; and,
<br />

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />SAN
<br />
<br />MARCOS,
<br />
<br />TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />"DP-2" (Duplex District-Medium Density) be rezoned "DP-1" (Duplex
<br />District-Low Density):
<br />
<br />BLOCK 29, LOTS 487-490; BLOCK 30, LOTS 481-486; BLOCK 33, LOTS
<br />511-516; BLOCK 34, LOTS 505-510 AND 543-548 OUT OF THE WESTOVER
<br />ADDITION TO THE CITY OF SAN MARCOS AS RECORDED IN VOLUME 59,
<br />PAGES 184-185 IN THE HAYS COUNTY DEED RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on March 9, 1987, it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this 23 day of February, 1987, subject
<br />to reconsideration at the next regular City Council meeting scheduled
<br />for March 9, 1987
