ORDINANCE NO. 2006- 1 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY AN AREA CONSISTING OF 30.17 ACRES, MORE OR LESS, LOCATED IN THE 1200 - 1400 BLOCKS OF CENTERPOINT ROAD (EDWARDS TRACT); APPROVING A SERVICE PLAN FOR THIS AREA; AND INCLUDING PROCEDURAL PROVISIONS. ;:"; )-- RECIT ALS: 1. The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two public hearings, held on March 21 , 2006 and on March 28 ,2006, to consider the proposed annexation by the City of 30.17 acres, more or less, located in the 1200-1400 blocks of Centerpoint Road, in Hays County, Texas (the "Annexation Area"), consisting of the tract of land described by metes and bounds in the attached Exhibit A. 2. The City has received a request from the owner and a petition from the developer for annexation of the property included in the Annexation Area, copies of which are attached as Exhibits B-1 and B-2. 3. An on-site public hearing has not been requested in writing by more than 10% of the adults who are permanent residents of the Annexation Area. 4. A notice of each of the public hearings was published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the Annexation Area, on March 5, 2006 and March 12, 2006 , these dates being on or after the 20th day and before the 10th day before the date of the respective hearings. A notice of each of the public hearings was also posted on the City's Internet web site on or after the 20th day and before the 10th day before the date of the respective hearings, and these notices remained posted on the web site until the dates of the respective hearings. 5. Prior to the publication of the notices of the public hearings, the City Council approved an extension of city water and wastewater. The resolution which included direction to prepare a service plan that provided for the extension of municipal services to the Annexation Area. A copy of the resolution is attached as Exhibit B-3. 6. The proposed service plan was made available for inspection and explained to the residents, if any, of the Annexation Area at the public hearings. 7. The Annexation Area is contiguous and adjacent to the current boundaries of the City. 8. Notice of all meetings of, and all deliberations of, the City Council involving the annexation of the Annexation Area, including public hearings and the vote(s) on adoption of this
