SECTION 1. Definitions: As used in this Ordinance the following words and <br />c, ;fihrases shall have the meaning ascribed to them in this section: <br /> <br />A. City- The City of San Marcos. Texas, a municipal corporation operating by <br />and under the laws of the State of Texas. situated in Hays County. <br /> <br />B. Service - Leal's Riverside Tire Service. <br /> <br />SECTION 2. Nature and Extent of Grant: For and in consideration ofthe payment <br />of the fee herein described and the Service equipping, maintaining and operating a <br />service using the streets of the City for the purpose of transporting persons using <br />innertubes to and from points on the San Marcos River, the City grants to the Service the <br />right and authority to operate and maintain one truck and trailer combination appropriate <br />for the transportation of persons and property upon the public streets of the City for a <br />term of six (6) months from the effective date of this franchise. <br /> <br />SECTION 3. Parking Obligations: For and in consideration of the grant of this <br />franchise, the Service agrees to: (1) clearly mark and maintain 11 parking spaces on site; <br />(2) not rent out more than 44 tubes at any given time (based on an assumed four tubes per <br />vehicle times 11 vehicles); and (3) inform customers about legal parking spaces and <br />discourage parking on streets in the residential neighborhood adjacent to the Service's <br />site. Should the Service wish to rent out more than 44 tubes at a given time in <br />conjunction with the use of an off-site parking, the Service agrees to first submit an <br />application for a special exception to the City Planning Department, and to implement the <br />change only if the special exception is approved by the Zoning Board of Adjustments. <br /> <br />SECTION 4. Route: The routes to be used by the Service are subject to the prior <br />written approval of the City's City Manager or his designee. The Service will provide the <br />City maps detailing the proposed routes. <br />
