" <br />1>- Lt- <br />",- CJ (~ <br />._),~ ~ : <br />;...- ~.I. <br /> <br />94. <br /> <br />ORDINANCE NO. 2006- 21 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 4.2.4.1 OF <br />THE CITY LAND DEVELOPMENT CODE TO EXTEND THE <br />DURATION OF THE DOWNTOWN BUILDING HEIGHT <br />OVERLAY DISTRICT; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENAL TIES. <br /> <br />r~) n .~ <br /> <br />RECITALS: <br /> <br />1. The City Planning and Zoning Commission conducted a public hearing on March 14, <br />2006 on a proposed amendment to Section 4.2.4.1 ofthe City Land Development Code to extend the <br />duration of the overlay district limiting building height in and near the central business area zoning <br />district. <br /> <br />2. The Planning and Zoning Commission voted on March 14, 2006, to recommend the <br />proposed amendment for adoption by the City Council. <br /> <br />3. The City Council conducted a public hearing on the proposed amendment on <br />May 2 , 2006. <br /> <br />4. All requirements of Chapter 1, Development Procedures, of the City Land Development <br />Code pertaining to this amendment have been met. <br /> <br />5. The City Council finds and determines that the adoption ofthe following ordinance is in <br />the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. Section 4.2.4.1 of the City Land Development Code is amended as follows <br />(underlining indicates added text; oyer strike indicates deleted text): <br /> <br />(b) Establishment of overlay district <br /> <br />A downtown building height overlay district is established in the area bounded on the <br />north by Pat Garrison Street and University Drive (extended to the San Marcos River), on <br />the east by the San Marcos River, on the south by the Union Pacific Railroad right-of- <br />way and Martin Luther King, Jr. Drive, and on the west by Comanche Street. The official <br />zoning map of the city is amended to incorporate this area as the downtown building <br />height overlay district. This Ordinance will remain in effect for a four-year two year <br />period beginning July 8, 2004, and it shall be automatically repealed on July 8, 2008 <br />~ unless continued in effect by express action of the City Council. <br />
