ORDINANCE NO. 2006- 24 U O:J AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 81.15 ACRES, MORE OR LESS, LOCA TED IN THE 3200-3300 BLOCKS OF HUNTER ROAD (FIRST BAPTIST CHURCH TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; AND INCLUDING PROCEDURAL PROVISIONS. RECIT ALS: 1. The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two public hearings, held on April 6 , 2006 and on April 18 ,2006, to consider the proposed annexation by the City of 81.15 acres, more or less, located at he southwest comer of McCarty Lane and Hunter Road, in Hays County, Texas (the "AIIDexation Area"), consisting of the tract of land, including right of way of Hunter Road, described by metes and bounds and shown in the attached Exhibits A-I and A-2 . 2. The City has received petitions for aIIDexation from the owner(s) of the property included in the Annexation Area, copies of which are attached as Exhibits B-1 and B-2. 3. The AIIDexation Area has no permanent residents. 4. A notice of each of the public hearings was published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the AIIDexation Area, on March 24. 2006 and March 31. 2006 , these dates being on or after the 20th day and before the 10th day before the date of the respective hearings. A notice of each of the public hearings was also posted on the City's Internet web site on or after the 20th day and before the 10th day before the date of the respective hearings, and these notices remained posted on the website until the dates of the respective hearings. 5. The proposed service plan was made available for inspection and explained to the residents, if any, of the AIIDexation Area at the public hearings. 6. The AIIDexation Area is contiguous and adjacent to the current boundaries of the City. 7. Notice of all meetings of, and all deliberations of, the City Council involving the annexation of the AIIDexation Area, including public hearings and the vote(s) on adoption of this ordinance, were done and performed in accordance with the Texas Open Meetings Law, TEX. GOV'T CODE ANN. Chapter 551, as amended. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The recitals ofthis ordinance are approved and adopted.
