<br /> II) 20. <br />~ 0 <br />...r ~e <br />c::::l <br />c::::l a:: <<1 <br />C"--.J w~ <br />W~ c:> ....Ie: <br />Uas <br />1 Ct:) >-cn <br />>- 1-- <br />-0 <br />0 u>. <br />:z ~ <br /><t U ORDINANCE 2005- 1 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />APPROVING THE RELEASE OF A PUBLIC UTILITY EASEMENT LOCATED IN LOT <br />34R, BLOCK P OF THE HUGHSON HEIGHTS ADDITION, SECTION 3-C, LOCATED <br />AT 832/834 SAGEWOOD TRAIL, TO THE NATIONAL CITY MORTGAGE <br />COMPANY; AUTHORIZING THE CITY MANAGER TO EXECUTE A RELEASE; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City is the holder of a Public Utility Easement granted by a plat recorded in Book 8, Page <br />34-37 of the Hays County Plat Records. The easement is 5-feet in width and runs along the side <br />and back lot lines of Lot 34R, Block P of the Hughson Heights Addition, Section 3-C. <br /> <br />2. The current owner of the property, National City Mortgage Company has requested that the <br />City release this easement. <br /> <br />3. The San Marcos staff has approved the release of this easement. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. That the attached release of the Public Utility Easement on Lot 34R, Hughson <br />Heights Addition, Section 3-C is approved. <br /> <br />SECTION 2. The City Manager, Dan O'Leary, is authorized to execute the attached <br />Release of Easement. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in full force if they can be given effect without the invalid portion. <br /> <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final passage, and <br />the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City. <br /> <br />PASSED AND APPROVED on first reading December 6, 2004. <br />PASSED AND APPROVED ON second reading December 13, 2004. <br /> <br />PASSED, APPROVED AND ADOPTED January 4, 2005. <br /> <br />~j9U <br /> <br />Mayor <br />
