ORDINANCE NO 2005 - ...1L AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS APPROVING THE RELEASE OF AN ELECTRICAL EASEMENT LOCATED IN LOT 2, GIL-MOR COMPANY SUBDIVISION LOCATED NEAR THE INTERSECTION OF STATE HIGHWAY 123 AND INTERSTATE 35 TO THE PROPERTY OWNER, JUD'S FOOD STORES, INC ,AUTHORIZING THE CITY MANAGER TO EXECUTE A RELEASE, AND PROVIDING AN EFFECTIVE DATE 1 The City is the successor-in-interest to an electrical easement located in Lot 2, Gil-Mor Company Subdivision, owned by Jud's Food Stores, I nc , and located near the intersection of State Highway 123 and Interstate 35 2 The property owner, Jud's Food Store, Inc has requested that the City release this easement. 3 The Electric Utility Department staff has reviewed and approved the release of this easement. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS SECTION 1 The terms and conditions of the attached Release of Easement are approved SECllON 2 The City Manager, Dan O'Leary, is authorized to execute the attached Release of Easement. SECTION 3 If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in full force if they can be given effect without the invalid portion SECTION 4 All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed SECTION 5 This Ordinance will take effect 10 days after the date of its final passage, and the City Clerk will publish notice of its adoption in a newspaper of general circulation in the City PASSED AND APPROVED on first reading January 4, 2005 PASSED AND APPROVED ON second reading January 18, 2005 PASSED, APPROVED AND ADOPTED February 1, 2005 ~1~ Mayor
