17 ORDINANCE 1986-11 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, EXTENDING THAT FRANCHISE AGREEMENT OF FEBRUARY 20, 1951 BETWEEN SAID CITY AND THE SAN MARCOS TELEPHONE COMPANY FOR A PERIOD OF SIX (6) MONTHS; AND DECLARING AN EFFECTIVE DATE. WHEREAS, that franchise agreement between the City of San Marcos, Texas, and the San Marcos Telephone Company of February 20, 1951 will expire February 19, 1986: and, WHEREAS, negotiations between the parties have not yet been completed regarding the terms of a subsequent franchise agreement under which said Telephone Company may operate in the City of San Marcos, Texas: and, WHEREAS, it is the intention of said parties that said franchise agreement not expire on February 19, 1986; now, there fore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the terms and conditions of that franchise agreement of February 20, 1951 between said City and the San Marcos Telephone Company, a copy of which is attached hereto and incorporated herein for all purposes, are hereby extended. SECTION 2. That the extension of said franchise agreement shall be for a term of six (6) months from the date of expiration of said franchise agreement, and Section 1 of said franchise agreement of February 20, 1951 is hereby amended to such extent. SECTION 3. That this Ordinance shall be in effect thirty (30) days from and after its final passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
