21 0' ~ ORDINANCE 1986-28 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE SAN MARCOS CODE OF ORDINANCES BY THE ADDITION OF CHAPTER 15 1/2 PROVIDING FOR REGULATION AND LICENSING OF LIMOUSINES; AND, DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the San Marcos Code of Ordinances is hereby amended by the addition of Chapter 15 1/2 as follows: Chapter 15 1/2 LIMOUSINES Sec. 15 1/2-1. Definitions. Certificate means a certificate of public convenience and necessity authorizing the holder thereof to conduct a limousine service in the city. Holder means a person to whom a certificate of public convenience and necessity has been issued. Limousine means an automobile having an enclosed compartment seating three or more passengers, usually with a driver's seat separated from the passenger compartment by a partition, and which is hired out or rented for a fee or charge. Person includes an individual, a corporation or other legal entity, a partnership, and any unincorporated association. Sec. 15 1/2-2. Certificate of public convenience and necessity required. No person shall provide a limousine service upon the streets of the city without having first obtained a certificate of public convenience and necessity from the city council. Sec. 15 1/2-3. Application for certificate. An application for a certificate shall be filed with the city secretary upon forms provided by the city. The application shall furnish the following information: (1) The name and address of the applicant. (2) The financial status of the applicant including the amounts of all unpaid judgments against each applicant and the nature of the transaction or acts giving rise to the judgments. (3) If the applicant is a partnership, the information in subsections (1), (2) and (5) shall be supplied for each partner. (4) If the applicant is a corporation, the name and place of residence of all of the officers of the corporation, a duly certified copy of its charter and bylaws, the amount of capital stock, the character and value of its assets, its liabilities and the security therefor, and if the corporation is a foreign corporation, a duly certified copy of its certificate of authority to transact business in the state.
