<br />21 <br /> <br /> <br /> <br />0' <br />~ ORDINANCE 1986-28 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING THE SAN MARCOS <br />CODE OF ORDINANCES BY THE ADDITION OF CHAPTER <br />15 1/2 PROVIDING FOR REGULATION AND LICENSING <br />OF LIMOUSINES; AND, DECLARING AN EFFECTIVE <br />DATE. <br /> <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That the San Marcos Code of Ordinances is <br />hereby amended by the addition of Chapter 15 1/2 as follows: <br /> <br />Chapter 15 1/2 <br /> <br />LIMOUSINES <br /> <br />Sec. 15 1/2-1. Definitions. <br /> <br />Certificate means a certificate of public <br />convenience and necessity authorizing the holder thereof <br />to conduct a limousine service in the city. <br /> <br />Holder means a person to whom a certificate of <br />public convenience and necessity has been issued. <br /> <br />Limousine means an automobile having an enclosed <br />compartment seating three or more passengers, usually <br />with a driver's seat separated from the passenger <br />compartment by a partition, and which is hired out or <br />rented for a fee or charge. <br /> <br />Person includes an individual, a corporation or <br />other legal entity, a partnership, and any <br />unincorporated association. <br /> <br />Sec. 15 1/2-2. Certificate of public convenience and <br />necessity required. <br /> <br />No person shall provide a limousine service upon <br />the streets of the city without having first obtained a <br />certificate of public convenience and necessity from the <br />city council. <br /> <br />Sec. 15 1/2-3. Application for certificate. <br /> <br />An application for a certificate shall be filed <br />with the city secretary upon forms provided by the <br />city. The application shall furnish the following <br />information: <br /> <br />(1) The name and address of the applicant. <br /> <br />(2) The financial status of the applicant <br />including the amounts of all unpaid judgments <br />against each applicant and the nature of the <br />transaction or acts giving rise to the <br />judgments. <br /> <br />(3) If the applicant is a partnership, the <br />information in subsections (1), (2) and (5) <br />shall be supplied for each partner. <br /> <br />(4) If the applicant is a corporation, the name <br />and place of residence of all of the officers <br />of the corporation, a duly certified copy of <br />its charter and bylaws, the amount of capital <br />stock, the character and value of its assets, <br />its liabilities and the security therefor, and <br />if the corporation is a foreign corporation, a <br />duly certified copy of its certificate of <br />authority to transact business in the state. <br />
