<br />78 <br /> <br /> <br /> <br />ORDINANCE 1985-9 <br /> <br />iI~ <br />\~,,¡ <br />¿; AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />~ OF SAN MARCOS, TEXAS AMENDING CHAPTER 21 OF THE <br />CODE OF ORDINANCES OF SAID CITY TO ADD AN <br />ARTICLE V ENTITLED "POLICE OFFICER SPECIAL <br />ASSIGNMENT SERVICES" AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br /> <br /> <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Chapter 2l of the Code of Ordinances of the <br />City of San Marcos, Texas, shall be amended to add the following <br />article to be numbered V which shall read as follows: <br /> <br />Article V. Police Officer Special Assignment Services. <br /> <br />Sec. 21-37. Purposes. <br /> <br />The purposes of this article are: <br /> <br />(1) To classify what has been known as Off-Duty <br />Security Jobs as Special Assignment Services <br />[hereinafter called Services]. <br /> <br />(2) To distribute Services duty equitably among the <br />officers of the San Marcos Police Department; <br /> <br />(3) To ensure that officers performing Services are in <br />an on-duty status for compensation, insurance, and all <br />other purposes; <br /> <br />(4) To provide a uniform rate of charges for <br />performance of Services¡ <br /> <br />(5) To ensure compliance by the officers, the <br />contractors, and the City with the Internal Revenue <br />Code¡ and, <br /> <br />(6) To give the Chief of Police clear authority over <br />officers performing Services. <br /> <br /> <br />Sec. 21-38. Contracts for employment of police officers. <br /> <br />Any person or business entity [hereinafter called <br />Contractor] wanting to employ San Marcos Police Officers for <br />Services shall contract with the City of San Marcos for the <br />desired police services. Contractors shall submit <br />applications for Services to the Chief of Police for review <br />and approval. <br /> <br />Sec. 21-39. Compensation. <br /> <br />The City shall charge a fee for these Services in the <br />amount of $17.50 per Police Officer per hour. The City will <br />pay the Police Officers $l2.50 per hour each. The City will <br />use five dollars ($5) per hour to cover administrative <br />benefit costs. The Contractor will deposit the required fee <br />with the Finance Department of the City at least 14 days <br />prior to the date of the function for which Services are <br />requested. If the request for Services is cancelled seven <br />(7) days or more before the function, the City will refund <br />the fee. If the request for Services is cancelled six (6) <br />days or less before the function, the City will retain the <br />fee. The Chief of Police will not approve any request for <br />less than two officer hours. The time periods designated <br />herein may be waived for good cause at the discretion of the <br />Chief of Police. <br />
