78 ORDINANCE 1985-9 iI~ \~,,¡ ¿; AN ORDINANCE OF THE CITY COUNCIL OF THE CITY ~ OF SAN MARCOS, TEXAS AMENDING CHAPTER 21 OF THE CODE OF ORDINANCES OF SAID CITY TO ADD AN ARTICLE V ENTITLED "POLICE OFFICER SPECIAL ASSIGNMENT SERVICES" AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Chapter 2l of the Code of Ordinances of the City of San Marcos, Texas, shall be amended to add the following article to be numbered V which shall read as follows: Article V. Police Officer Special Assignment Services. Sec. 21-37. Purposes. The purposes of this article are: (1) To classify what has been known as Off-Duty Security Jobs as Special Assignment Services [hereinafter called Services]. (2) To distribute Services duty equitably among the officers of the San Marcos Police Department; (3) To ensure that officers performing Services are in an on-duty status for compensation, insurance, and all other purposes; (4) To provide a uniform rate of charges for performance of Services¡ (5) To ensure compliance by the officers, the contractors, and the City with the Internal Revenue Code¡ and, (6) To give the Chief of Police clear authority over officers performing Services. Sec. 21-38. Contracts for employment of police officers. Any person or business entity [hereinafter called Contractor] wanting to employ San Marcos Police Officers for Services shall contract with the City of San Marcos for the desired police services. Contractors shall submit applications for Services to the Chief of Police for review and approval. Sec. 21-39. Compensation. The City shall charge a fee for these Services in the amount of $17.50 per Police Officer per hour. The City will pay the Police Officers $l2.50 per hour each. The City will use five dollars ($5) per hour to cover administrative benefit costs. The Contractor will deposit the required fee with the Finance Department of the City at least 14 days prior to the date of the function for which Services are requested. If the request for Services is cancelled seven (7) days or more before the function, the City will refund the fee. If the request for Services is cancelled six (6) days or less before the function, the City will retain the fee. The Chief of Police will not approve any request for less than two officer hours. The time periods designated herein may be waived for good cause at the discretion of the Chief of Police.
