<br /> RESOLUTION 1985-4R 79 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS, APPROVING THE <br /> TERMS AND CONDITIONS OF AN AGREEMENT FOR <br /> MUTUAL AID IN FIRE PROTECTION BETWEEN <br /> SAID CITY AND THE SOUTH HAYS COUNTY <br /> VOLUNTEER FIRE DEPARTMENT, INC. ~ <br /> AUTHORIZING THE MAYOR OF SAID CITY TO <br /> EXECUTE SAID AGREEMENT~ AND DECLARING AN <br /> EFFECTIVE DATE. <br /> WHEREAS, The State of Texas pursuant to Article 6228f, <br /> Texas Revised civil Statutes, has declared it to be the <br /> public policy of the State to provide financial assistance to <br /> the surviving spouse and minor children of paid firemen when <br /> such paid firemen suffer violent death in the course of the <br /> performance of their dutiesi and, <br /> WHEREAS, the federal government, pursuant to 42 U.S.C.S. <br /> §3796, provides for the payment of certain benefits to the <br /> surviving spouse and/or children of public safety officers <br /> who have died as a "proximate result of a personal injury <br /> sustained in the line of duty"~ and, <br /> WHEREAS, insurance contracts entered into by some <br /> firemen and various pension systems provide for the payment <br /> of death, disability and/or injury benefits when death or <br /> injury occur "in the line of duty"¡ and, <br /> WHEREAS, it is to the benefit of the firemen of the City <br /> of San Marcos to have clearly established that responding to <br /> or working at a fire or other emergency outside said City's <br /> jurisdictional area but within an area for which the City of <br /> San Marcos has entered into an Agreement For Mutual Aid In <br /> Fire Protection is work "in the line of duty" for City of San <br /> Marcos firemen~ and, <br /> WHEREAS, the City of San Marcos has the authority, <br /> pursuant to its Charter and State law, to enter into <br /> agreements for the provision of fire protection services~ <br /> now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> HARCOS, TEXAS: <br /> PART 1. That the terms and conditions of an Agreement <br /> For Mutual Aid In Fire Protection between the City of San <br /> Harcos, Texas, and the South Hays County Volunteer Fire <br /> Department, Inc., a copy of which is attached hereto as <br /> Exhibit A and incorporated herein for all intents and <br /> purposes, are hereby approved in all respects. <br /> PART 2. That the Mayor of the City of San Harcos, <br /> Texas, Emmie Craddock, be, and she is hereby, authorized to <br /> execute said Agreement on behalf of the City of San Marcos, <br /> Texas. <br /> PART 3.
