<br />130 <br /> <br /> <br />Q\. <br />rl <br />ORDINANCE No. 1985-19 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS AMENDING SECTION <br />1 OF ORDINANCE 1984-100 ADOPTED NOVEMBER 5, <br />1984 WHICH DECLARED A BUILDING MORATORIUM <br />FOR 120 DAYS ON DEVELOPMENTAL APPROVALS, <br />INCLUDING APPROVAL OF ZONING CHANGES, PLATS, <br />AND BUILDING PERMITS, ON ALL LAND AREA <br />LOCATED WITHIN THE ONE HUNDRED (100) YEAR <br />FLOOD PLAIN OF THE SAN MARCOS RIVER TO <br />EXTEND SAID MORATORIUM THROUGH JUNE 11, <br />1985 AND DECLARING AN EMERGENCY. <br /> <br /> <br /> <br />WHEREAS, the City Council of the City of San Marcos, <br />Texas has determined that the environmental integrity <br />of the San Marcos River ecosystem will be adversely im- <br />pacted from development if the building moratorium de- <br />clared by Ordinance 1984-100 is not extended; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That Section 1 of Ordinance 1984-100 <br />adopted on November 5, 1984 declaring a building moratorium <br />for 120 days on developmental approvals, including approval <br />of zoning changes, plats, and building permits, on all <br />land area located within the one hundred (100) year flood <br />plain of the San Marcos River from Spring Lake to the <br />confluence of the Blanco and San Marcos Rivers is here- <br />by amended to read as follows: <br /> <br />SECTION 1. That from and after the effective <br />date of this Ordinance no developmental approvals <br />shall be made by said City, including approval of <br />zoning change9' plats, and building permits, on <br />any land area located within the one hundred (100) <br />year flood plain of the San Marcos River with all <br />Soil Conservation Service dam projects in place, <br />as shown in the Watershed Plan and Environmental <br />Impact Statement, USDA-SCS-EIS-WS-(ADM)-78-2(F)-(TX) , <br />from Spring Lake to the confluence of the Blanco <br />and San Marcos Rivers,through June 11,1985 or after <br />the adoption of an Interim Comprehensive Development <br />Ordinance, whichever is sooner, the purpose of such <br />ordinance being to protect the environmental in- <br />tegrity of the San Marcos River ecosystem from ad- <br />verse impact resulting from development in the <br />above defined area. <br /> <br />SECTION 2. That the importance of this Ordinance to <br />the public welfare and for the public good creates an emer- <br />gency and an imperative public necessity so that the pro- <br />visions of the Charter requiring that ordinances shall be <br />presented at three separate meetings and that no ordinance <br />shall become effective until the expiration of ten (10) <br />days following the date of its final passage be suspended, <br />and these provisions are hereby suspended, and this Ordi- <br />nance shall take effect and be in full force and effect <br />from and after its adoption and after its publication in a <br />newspaper of general circulation within the City. <br /> <br />PASSED, APPROVED, AND ADOPTED this 25 day of <br /> <br />February' 1985. <br /> <br />~ø~ <br /> <br />Emmie Craddock <br />Mayor <br /> <br />Attest: <br /> <br />rxJ~~~ <br /> <br />Janis K.
