<br />12 <br /> <br /> <br />ORDINANCE 1984-2 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, ESTABLISHING THE RECORD <br />LOCATION OF THE Cill~ON BOUNDARY BETWEEN THE <br />TWO ALLEYS TRAVERSING BLOCK 20 IN THE ORIGINAL <br />TOWN OF SAN MARCOS, HAYS COUNTY, TEXAS, ACCORDING <br />TO THE MAP OF SAID ORIGINAL TOWN OF RECORD IN <br />VOLUME 1, PAGE 20, OF THE PLAT RECORDS OF HAYS <br />COUNTY, TEXAS, AND THAT CERTAIN TRACT OF LAND <br />CONVEYED BY RODGER M. ZIMMERMAN TO COLLIER M. <br />SUBLETT BY DEED DATED AUGUST 21, 1981 AND RE- <br />CORDED IN VOLUME 363, PAGE 645 OF THE DEED RECORDS <br />OF HAYS COUNTY, TEXAS, AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br /> <br />WHEREAS, the map or plat of the Original Town of San <br />Marcos in Hays County, Texas recorded in Volume 1, Page 20 <br />of the Plat Records of Hays County, Texas does not show with <br />precision the record location of the alleys and streets <br />depicted thereon; <br /> <br />WHEREAS, the two alleys traversing Block 20 of said <br />Original Town of San Marcos have been in use on the ground for <br />many years but the common boundary between them and the portion <br />of said Block 20 conveyed to Collier M. Sublett by the deed <br />hereinabove referred to has not been established as a matter of <br />record; <br /> <br />WHEREAS, Collier M. Sublett has requested the City of <br />San Marcos to establish the record location of said common <br />boundary; <br /> <br />WHEREAS, it is in the public interest and in the proprietary <br />interest of the City of San Marcos (as it owns land in said <br />Block 20 which also is bounded by said alleys), to establish <br />forever the location of said common boundary; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That the common line between the two alleys <br />traversing Block 20 of the Original Town of San Marcos as <br />recorded in Volume 1, Page 20 of the Hays County Plat Records, <br />and that certain tract of land out of said Block 20 described <br />in that certain deed from Rodger M. Zimmerman to Collier M. <br />Sublett dated August 21, 1981 and recorded in Volume 363, Page <br />645 of the Hays County Deed Records be, and the same is here- <br />by, forever established and located as a matter of record as <br />set forth in those certain field notes and plat prepared under <br />date of October 17, 1983, by David C. Williamson, Registered <br />Professional Surveyor, a copy of which is attached hereto as <br />Exhibit A and incorporated herein for all intents and purposes. <br /> <br />SECTION 2.
