<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
<br /> OF SAN MARCOS, TEXAS, ABANDONING AND VACATING
<br /> A PORTION OF AN ALLEY AND A PORTION OF NEVADA
<br /> STREET IN THE Z. WILLIAMSON THIRD ADDITION TO
<br /> THE CITY OF SAN MARCOS, TEXAS; AUTHORIZING THE
<br /> MAYOR OF SAID CITY TO EXECUTE A SPECIAL
<br /> DEED TO JOHN J. STOKES; REFLECTING PAYMENT OF
<br /> THE FAIR MARKET VALUE OF SIX HUNDRED THIRTY
<br /> DOLLARS ($630.00) BY JOHN J. STOKES;
<br /> FOR THE REVERSION OF FEE IN SAID LAND AND
<br /> DECLARING AN EFFECTIVE DATE.
<br /> WHEREAS, a portion of an alley and a portion of Nevada
<br />Street in the Z. Williamson Third Addition to the City of
<br />San Marcos, the plat of said subdivision recorded in Volume
<br />59, Page 545, Hays County Deed Records, said portion of said
<br />alley being located between Hamilton Street and Nevada Street,
<br />being 150 feet long and 15 feet wide and being that portion
<br />which abuts lots 24, 25, 26, 37, 38 and 39, and said portion
<br />of Nevada Street being located between Indiana (formerly
<br />Indian) Street and an alley between Hamilton Street and
<br />Perkins Street, (a portion of the former McNeill Road) being
<br />160 feet lohg and 50 feet wide, and being that portion which
<br />lS located between lots 68 and 69; were and are dedicated to
<br />public use on the plat of the Z. Williamson Third Additioh to the
<br />City of San Marcos of record in Volume 59, Page 545 of the Deed
<br />Records of Hays County, Texas; and,
<br /> WHEREAS, the City of San Marcos has been requested by
<br />John J. Stokes to abandon said portions of said alley and
<br />street; and,
<br /> WHEREAS, the City of San Marcos has duly determined that
<br />John J. Stokes is the sole owner of all property abutting said
<br />portions of said alley and street; and,
<br /> WHEREAS, the City Council of the City of San Marcos,
<br />Texas, had determined that it is in the public interest to
<br />abandon said portions of said alley and street; and,
<br /> WHEREAS, said owner of all land abutting said portions
<br />of said alley and street has executed a release, discharging
<br />said City from any damages occasioned by said vacation and
<br />abandonment; and,
<br /> WHEREAS, the City has determined by appraisal that the
<br />fair market value of said property is six Hundred Thirty Dollars
<br />($630.00) and the same has previously been deposited with the
<br />City; now, therefore,
<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS, TEXAS:
<br /> SECTION 1. That a portion of an alley and a portion of
<br />Nevada Street in the Z. Williamson Third Addition to the City of
<br />San Marcos, the plat of said subdivision recorded in Volume 59,
<br />Page 545, Deed Records of Hays County, Texas, said portion of
<br />said alley being located between Hamilton Street and Nevada
<br />Street, being 150 feet long and 15 feet wide and being that
<br />portion which abuts lots 24, 25, 26, 37, 38 and 39 of said
<br />subdivision, said portion of said street being located between
<br />Indiana (formerly Indian) Street and an alley between Hamilton
<br />Street and Perkins Street, (a portion of the former McNeill Road)
<br />being 160 feet lohg and 50 fee~ wide and being that portion which
<br />is located between lots 68 and 69 of said subdivision, be, and
<br />they are hereby declared to be, and are henceforth vacated and
<br />abandoned as to any use, right or claim in, or responsibility for
<br />the upkeep and maintenance by the public in general and the City
<br />of San Marcos in particular.
