<br /> 71 <br /> ORDINANCE 1984-21 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS AMENDING SECTION 4 OF <br /> ORDINANCE 1983-80 ADOPTED DECEMBER 29, 1983 TO <br /> INCREASE THE MEMBERSHIP OF THE BOARD OF <br /> DIRECTORS, DESIGNATING THE NUMBER OF <br /> APPOINTMENTS TO BE MADE BY EACH TAXING UNIT TO <br /> SUCH BOARD, SETTING FORTH THE TERMS OF SUCH <br /> BOARD MEMBERS AND DECLARING AN EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> SECTION 1. That section 4 of Ordinance 1983-80 adopted <br />December 29, 1983 is hereby amended in its entirety to read <br />as follows: <br /> section 4. That there is hereby established a <br /> board of directors for the zone which shall <br /> consist of seven (7) members. within sixty (60) <br /> days of the date hereof the City Council of the <br /> City will appoint three ( 3) residents of the <br /> City, who meet the eligibility requirements as <br /> set forth in the Act, to serve as members of the <br /> board of directors. <br /> The San Marcos Consolidated Independent School <br /> District, a taxing unit that levies real property <br /> taxes in the reinvestment zone, may appoint two <br /> ( 2) members to the board of directors. Hays <br /> County, a taxing unit that levies real property <br /> taxes in the reinvestment zone, may appoint two <br /> ( 2) members to the board of directors. Either <br /> taxing unit may waive its right to such <br /> appointment either by direct waiver or by failure <br /> to act in a timely fashion as provided herein. <br /> If any taxing unit does waive its right to such <br /> appointment, the City Council may appoint a <br /> director to fill the position, based upon the <br /> recommendation of the other directors. After the <br /> term of such appointed director, the taxing unit <br /> may exercise its right to appoint a director or <br /> it may waive its right again. All appointments <br /> must be made within sixty (60) days of the date <br /> hereof. The City Council shall appoint two ( 2) <br /> directors for two-year terms; the San Marcos <br /> Consolidated Independent School District shall <br /> appoint one ( 1) director for a two-year term; <br /> Hays County shall appoint one (1) director for a <br /> two-year term; the remaining three (3) directors <br /> shall be appointed for one-year terms. All <br /> subsequent appointments will be made for two-year <br /> staggered terms. Within sixty (60) days of the <br /> date hereof, the City Council shall designate one <br /> of the directors to serve as chairman of the <br /> board of directors for the year ending December <br /> 31, 1984, and shall authorize the board to elect <br /> from its members a vice chairman and other <br /> officers as it sees fit. The City hereby <br /> establishes and adopts bylaws for the board of <br /> directors of the Zone a copy of which is attached <br /> hereto as Exhibit C, and delegates to the board <br /> the powers and authority as provided therein. <br /> The board of directors shall make recommendations <br /> to the City Council concerning the administration <br /> of the Zone. It shall prepare or cause to be <br /> prepared and adopt a project plan for the Zone <br /> and must submit such plan to the City Council for <br />
