72 ORDINANCE 1984-22 AN ORDINANCE OF THE CITY COUNCIL OF THE CI'rY OF SAN MARCOS, TEXAS AMENDING SECTION 1 OF ARTICLE II OF EXHIBIT C OF ORDINANCE 1983-80 ADOPTED DECEMBER 29, 1983 TO INCREASE THE MEMBERSHIP OF THE BOARD OF DIRECTORS, DESIGNATING THE NUMBER OF APPOINTMENTS TO BE MADE BY EACH TAXING UNIT TO SUCH BOARD, SETTING FORTH THE TERMS OF SUCH BOARD MEMBERS . AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Section 1 of Article II of Exhibit C of Ordinance 1983-80 adopted December 29, 1983 is hereby amended in its entirety to read as follows: Section 1. Powers, Number and Term of Office. The property and affairs of the Zone shall be managed and controlled by the city Council based on the recommendations of the Board of Directors and subj ect to the restrictions imposed by law, the Ordinance creating the Zone and these Bylaws. The Board of Directors shall exercise all of the powers necessary to implement the project plan which are by written ordinance delegated to it by the City Council. The Board of Directors shall consist of seven (7) directors. The San Marcos Consolidated Independent School District, a taxing unit that levies real property taxes in the reinvestment zone, may appoint two (2) members to the board of directors. Hays County, a taxing unit that levies real property taxes in the reinvestment zone, may appoint two (2) members to the board of directors. A unit may waive its right to such appointment either by direct waiver or by failure to act in a timely fashion as provided herein. If any taxing unit does waive its right to such appointment, the City Council may appoint a director to fill the position, based upon the recommendation of the other directors. After the term of such appointed director, the taxing unit may exercise its right to appoint a director or it may waive its right again. The remaining directors shall be appointed by the City Council. The directors constituting the first Board of Directors shall be those selected pursuant to the Ordinance creating the Zone, of whom four (4) shall serve for two (2) years, and three (3) of whom shall serve for one (1) year, or until his or her successor is appointed as hereinafter provided. Subsequent directors shall hold office for a term of two ( 2) years or until their successors are appointed as hereinafter provided. Any director may be removed from office by the City Council, for cause or at will. SECTION 2. That this Ordinance shall be in effect ten days from and after its passage and publication in a newspaper of general circulation in the area.
