<br /> 72 <br /> ORDINANCE 1984-22 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CI'rY <br /> OF SAN MARCOS, TEXAS AMENDING SECTION 1 OF <br /> ARTICLE II OF EXHIBIT C OF ORDINANCE 1983-80 <br /> ADOPTED DECEMBER 29, 1983 TO INCREASE THE <br /> MEMBERSHIP OF THE BOARD OF DIRECTORS, <br /> DESIGNATING THE NUMBER OF APPOINTMENTS TO BE <br /> MADE BY EACH TAXING UNIT TO SUCH BOARD, <br /> SETTING FORTH THE TERMS OF SUCH BOARD MEMBERS <br /> . AND DECLARING AN EFFECTIVE DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. That Section 1 of Article II of Exhibit C of <br /> Ordinance 1983-80 adopted December 29, 1983 is hereby amended <br /> in its entirety to read as follows: <br /> Section 1. Powers, Number and Term of Office. <br /> The property and affairs of the Zone shall be <br /> managed and controlled by the city Council based <br /> on the recommendations of the Board of Directors <br /> and subj ect to the restrictions imposed by law, <br /> the Ordinance creating the Zone and these Bylaws. <br /> The Board of Directors shall exercise all of the <br /> powers necessary to implement the project plan <br /> which are by written ordinance delegated to it by <br /> the City Council. <br /> The Board of Directors shall consist of seven (7) <br /> directors. The San Marcos Consolidated <br /> Independent School District, a taxing unit that <br /> levies real property taxes in the reinvestment <br /> zone, may appoint two (2) members to the board of <br /> directors. Hays County, a taxing unit that <br /> levies real property taxes in the reinvestment <br /> zone, may appoint two (2) members to the board of <br /> directors. A unit may waive its right to such <br /> appointment either by direct waiver or by failure <br /> to act in a timely fashion as provided herein. <br /> If any taxing unit does waive its right to such <br /> appointment, the City Council may appoint a <br /> director to fill the position, based upon the <br /> recommendation of the other directors. After the <br /> term of such appointed director, the taxing unit <br /> may exercise its right to appoint a director or <br /> it may waive its right again. The remaining <br /> directors shall be appointed by the City Council. <br /> The directors constituting the first Board of <br /> Directors shall be those selected pursuant to the <br /> Ordinance creating the Zone, of whom four (4) <br /> shall serve for two (2) years, and three (3) of <br /> whom shall serve for one (1) year, or until his <br /> or her successor is appointed as hereinafter <br /> provided. Subsequent directors shall hold office <br /> for a term of two ( 2) years or until their <br /> successors are appointed as hereinafter provided. <br /> Any director may be removed from office by the <br /> City Council, for cause or at will. <br /> SECTION 2. That this Ordinance shall be in effect ten <br /> days from and after its passage and publication in a <br /> newspaper of general circulation in the area. <br />
