<br /> 106 <br /> RESOLUTION 1984-l5R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS AUTHORIZING THE MAYOR <br /> OF THE CITY OF SAN MARCOS, TEXAS, TO ENTER <br /> INTO A CONTRACT FOR THE COLLECTION OF <br /> DELINQUENT AD VALOREM TAXES WITH C.W. ROBIN <br /> PEARCY AND HEARD, GOGGAN AND BLAIR, ATTORNEYS <br /> AT LAW AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the City Council of the City of San Marcos, wishes <br /> to contract with private attorneys for the collection of delinquent <br /> ad valorem taxes; and, <br /> WHEREAS, private attorneys who are under contract with the <br /> City will be able to recover a fifteen percent (15%) penalty <br /> against the delinquent taxpayer as authorized by Section 33.07 <br /> of the Texas Property Tax Code; and, <br /> WHEREAS, the fifteen percent (15%) penalty can be used to <br /> pay said private attorneys under contract with the City; and, <br /> WHEREAS, the attached contract with C.W. Robin Pearcy <br /> and Heard, Goggan and Blair, Attorneys at law sets fifteen <br /> percent (15%) fee for their services; and, <br /> WHEREAS, the City will not have to pay any initial costs <br /> for the collection of delinquent taxes; and, <br /> WHEREAS, contracting with private attorneys will shift the <br /> burden of costs of a delinquent tax campaign from the taxpayers <br /> to non-taxpayers; and, <br /> WHEREAS, such a system ~ill permit the overburden~d resources <br /> of the City Attorney's Office to be devoted to other vital matters; <br /> now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That C.W. Robin Pearcy and Heard, Goggan and Blair, <br /> Attorneys at Law, are hereby authorized to collect delinquent <br /> ad valorem taxes for the City of San Marcos as provided by the terms <br /> of the contract which is attached hereto and incorporated herein <br /> for all intents and purposes, and the same is hereby approved in <br /> all respects. <br /> PART 2. That the Mayor of the City of San Marcos, Texas, <br /> Emmie Craddock, is hereby authorized to execute said contract on <br /> behalf of the City. <br /> PART 3.
