<br /> l30 <br /> ORDINANCE 1983-9 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br /> SAN .f\1ARCOS, TEXAS, N1ENDING SECTION 29-132 OF <br /> THE CODE OF ORDINANCES, CITY OF SAN ~1ARCOS, <br /> TEXAS, TO SET ZONES AND RATES OF SPEED ON PORTIONS <br /> Q OF STATE HIGHWAY 80 LOCATED WITHIN THE CORPORATE <br /> LIMITS OF THE CITY OF SAN MARCOS, TEXAS: DEFINE <br /> SPEEDING AND FIX A PENALTY THEREFOR; DECLARE <br /> WHAT .f\1AY BE A SUFFICIENT COMPLAINT IN PROSECUTIONS <br /> HEREUNDER; PROVIDE FOR SEVERABILITY; REPEAL <br /> CONFLICTING LAWS AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, pursuant to Section 167 of the Texas Uniform Act <br /> Regulating Traffic on Highways, Article 6701d, Texas Revised <br /> Civil Statutes, the State Highway Commission may alter prima <br /> facie maximum speed limits with respect to any part of any high- <br /> way, road or street officially designated or marKed by said <br /> Commission as part of the State Highway System on the basis of <br /> an engineering and traffic investigation, said investigation <br /> taking into consideration the width and condition of the pave- <br /> ment and other circumstances on such portion of said highway as <br /> well as the usual traffic thereon; and, <br /> ~vHEREAS, such an engineering and traffic investigation has <br /> been conducted on a portion of State Highway 80 within the corporate <br /> limits of the City of San Marcos, Texas; and, <br /> WHEREAS, on the basis of said investigation, said Commission <br /> has determined that the prima facie maximum speed limit on portions <br /> of State Highway 80 located within the corporate limits of the <br /> City of San Harcos, Texas, should be altered as set out on the <br /> attached Exhibit A; now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN ~IARCOS, <br /> TEXAS: <br /> SECTION 1. That it is hereby determined upon the basis of <br /> an engineering and traffic investigation that the prima facie <br /> maximum speed limit on those portions of State Highway 80 located <br /> within the corporate limits of the City of San Marcos, Texas, <br /> shall be as follows: <br /> (a) For Eastbound Traffic on State Highway 80. <br /> (1) Beginning at the west access road to Inter- <br /> state Highway 35, said point being milepoint <br /> 0.000 on the Attached Exhibit A, for a distance <br /> of 0.340 miles in a southeasterly direction on <br /> said State Highway 80, said point being mile- <br /> point 0.340 on the attached Exhibit A, a prima <br /> facie maximum speed limit of 35 miles per hour. <br />
