<br />6 <br /> <br /> <br />ORDINANCE 1983-11 <br /> <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, VACATING AND ABANDONING <br />A PORTION OF AN ALLEY LOCATED ADJACENT TO LOTS <br />103, 104, 117 AND 118 IN BLOCK 12 OF THE í'JESTOVER ADDITION <br />TO SAID CITY, PROVIDING FOR THE REVERSION <br />OF FEE IN SAID LAND AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br /> <br />WHEREAS, the City of San Marcos has received a request <br />to vacate and abandon that portion of an alley in Block 12 <br />of the Westover Addition to the City of San Marcos which <br />abuts lots 103, 104, 117 and 118 of said Block 12; and, <br /> <br />WHEREAS, the City of San Marcos has duly determined <br />that Harry Bishop and H.M. Brittain are the owners of Lots <br />103, 104, 117 and 118 in Block 12 of the Westover Addition <br />to said City, a subdivision of record in Volume 59, Page <br />184 of the Hays County Deed Records; and, <br /> <br />WHEREAS, the City Council of the City of San Marcos, <br />Texas, has determined that it is in the public interest <br />to abandon said portion of said alley in Block 12 of the <br />Westover Addition; and, <br /> <br />WHEREAS, Harry Bishop and H.~1. Brittain have executed <br />a release, discharging said City from any damages occasioned <br />by said vacation and abandonment; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />SECTION 1. That the portion of the alley in Block 12 <br />of the Westover Addition to the City of San Marcos which <br />abuts Lots 103, 104, 117 and 118 of said Block 12, be and is <br />hereby declared to be, and is henceforth vacated and abandoned <br />as to any use, right or claim in, or responsibility for the <br />upkeep or maintenance by the public in general and the City <br />of San Marcos, in particular. <br /> <br />SECTION 2. That the fee to said portion of said alley <br />abutting Lots 103, 104, l17 and 118 of said Block l2 in the <br />Westover Addition to the City of San Marcos, is hereby re- <br />leased and shall revert to Harry Bishop and H.M. Brittain <br />in proportion to their abutting ownership save and except <br />that easements are reserved for any and all existing utilities. <br /> <br />SECTION 3.
