6 ORDINANCE 1983-11 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, VACATING AND ABANDONING A PORTION OF AN ALLEY LOCATED ADJACENT TO LOTS 103, 104, 117 AND 118 IN BLOCK 12 OF THE í'JESTOVER ADDITION TO SAID CITY, PROVIDING FOR THE REVERSION OF FEE IN SAID LAND AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos has received a request to vacate and abandon that portion of an alley in Block 12 of the Westover Addition to the City of San Marcos which abuts lots 103, 104, 117 and 118 of said Block 12; and, WHEREAS, the City of San Marcos has duly determined that Harry Bishop and H.M. Brittain are the owners of Lots 103, 104, 117 and 118 in Block 12 of the Westover Addition to said City, a subdivision of record in Volume 59, Page 184 of the Hays County Deed Records; and, WHEREAS, the City Council of the City of San Marcos, Texas, has determined that it is in the public interest to abandon said portion of said alley in Block 12 of the Westover Addition; and, WHEREAS, Harry Bishop and H.~1. Brittain have executed a release, discharging said City from any damages occasioned by said vacation and abandonment; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That the portion of the alley in Block 12 of the Westover Addition to the City of San Marcos which abuts Lots 103, 104, 117 and 118 of said Block 12, be and is hereby declared to be, and is henceforth vacated and abandoned as to any use, right or claim in, or responsibility for the upkeep or maintenance by the public in general and the City of San Marcos, in particular. SECTION 2. That the fee to said portion of said alley abutting Lots 103, 104, l17 and 118 of said Block l2 in the Westover Addition to the City of San Marcos, is hereby re- leased and shall revert to Harry Bishop and H.M. Brittain in proportion to their abutting ownership save and except that easements are reserved for any and all existing utilities. SECTION 3. That this Ordinance shall be effective ten (10) days from and after its passage and publication in a newspaper of general circulation. PASSED AND APPROVED on first reading January 24, 1983.
